3 <br /> <br />Contractor shops and offices are allowed in the GB, General Business District with approval of <br />a Conditional Use Permit. While typically staff would recommend that the property be rezoned <br />to LI-Light Industrial to make the zoning consistent with the future Land Use designation, the <br />property owner asked to keep the existing zoning. Since the proposed use is consistent with the <br />existing zoning district and with the guided use and surrounding uses, rezoning the property is <br />not required at this time. While the applicant is not specifically requesting a rezoning at this <br />time, state law does require that that the zoning map be brought into conformance within nine <br />months of adoption of a comprehensive plan (Minnesota Stat. §453.858) and the City will <br />likely rezone the property as part of the 2040 Comprehensive Plan implementation in 2019 <br /> <br />Site and Building Plan Review <br /> <br />The applicant is proposing a 3,024-sq.ft. 22½-foot tall (measured as the average height of <br />gables) contractor shop on a 35,962-sq. ft. parcel. The plans show that there is room for future <br />expansion (1,200 sq. ft) of the shop on the south side of the building and a potential showroom <br />(576 sq. ft.) on the north side of the building, which, if constructed would bring the total <br />building area to 4,800 sq. ft. The proposed initial construction and future phases comply with <br />the required building height, building setbacks, lot size and lot widths with the GB, General <br />Business District, however, the site plan shows that they do not comply with the parking lot <br />setbacks. The applicant will be required to revise plans to bring them into compliance with the <br />GB, General Business District standards. <br /> <br />Comments: <br /> <br />1. Plan sheets shall be revised to bring site layout into compliance with the required <br />setbacks for the GB, General Business District. <br /> <br />After further review, the setbacks would not need to be revised. The setback along a collector <br />road in a GB, General Business district is 40 feet. The submitted plans provide a 50 foot <br />setback which is consistent with industrial zoning districts. As discussed above, the property <br />will likely be rezoned in the future to be consistent with the comprehensive plan. <br /> <br />2. Sheet A2: <br />a. Height of building and accessory storage building and measurements shall <br />be included on plan sheet. <br /> <br />Access <br /> <br />Access to the site is provided on the northeast corner of the site from Apollo Drive, which is a <br />County Highway. Plans have been sent to Anoka County for review and comment. The site has <br />limited options for access and the applicant will need to work with Anoka County to ensure that <br />site lines are compatible with adjacent parcels and access drives for properties across the street. <br /> <br />Comments: <br /> <br />1. Review of plans by Anoka County is required, prior to building permit. <br /> <br />
