COUNCIL MINUTES June 11, 2018 <br />DRAFT <br />4 <br />6A) Consider Resolution 18-69, Approving Grading and Trunk Utility Agreement, 118 <br />Watermark - City Engineer Hankee reviewed the written staff report. She noted the specifics of the 119 <br />agreement. 120 <br /> 121 <br />Council Member Stoesz noted the hours of construction activity. He wonders if, because of the 122 <br />location far from anything, the developer has expressed interest in extending working hours. Ms. 123 <br />Hankee said the hours included in the agreement mirror those in city code. Community Development 124 <br />Director Grochala added that staff is currently working on an amendment dealing with a variance 125 <br />process for construction noise. 126 <br /> 127 <br />Council Member Manthey moved to approve Resolution No. 18-69 as presented. Council Member 128 <br />Maher seconded the motion. Motion carried on a voice vote. 129 <br /> 130 <br />6B) Nature’s Refuge – i. Consider First Reading of Ordinance No. 05-18 Rezoning 131 <br />Property from R-1, Single Family Residential to PUD, Planned Unit Development; ii. Consider 132 <br />Resolution No. 18-70 Approving PUD Development Stage Plan/Preliminary Plat – City Planner 133 <br />Larsen reviewed a PowerPoint presentation including information on: 134 <br />- Aerial view of proposed development; 135 <br />- Council’s expressed concern about some of the PUD flexibility; staff spoke with 136 <br />developer and they will work on lots to bring them to minimum standards; 137 <br />- With that, staff would still like to review the proposal so as to hear any other concerns 138 <br />or questions at this time; 139 <br />- History on original Nature’s Refuge development; 140 <br />- Existing site conditions, includng acreage, tree cover, wetland complex, rare plant and 141 <br />animal species, 142 <br />- Ditch and easement present; 143 <br />- Density implications (low end of spectrum); 144 <br />- Original site plan compared to current revised site plan; 145 <br />- Trail location; 146 <br />- Preliminary Plat (noted that it will be amended as previously discussed); 147 <br />- Tree preservation plan (including tree buffers); 148 <br />- Traffic study and level of service (C); 149 <br />- Wetland impact review; 150 <br />- Findings of Fact are included in council resolution; 151 <br />- PUD Flexibility Summary (and what will be omitted). 152 <br /> 153 <br />Planner Larsen noted that the council could elect to approve the actions, with the changes outlined 154 <br />understood, or to table the matter. 155 <br /> 156 <br />Mayor Reinert thanked staff for the extra effort in responding to his concerns about a certain element of 157 <br />the PUD proposed. He doesn’t think that flexibility is a bad thing, however, he sees that the City’s 158 <br />ordinances are generally upheld and very few variances are allowed. He had concerns with the PUD 159 <br />presented at the work session so he brought those forward. He’d like to have further discussion about 160 <br />the City’s R1 zoning designation; is it still correct for this City? He sees the development is nice and 161
