18 <br />RECOMMENDATION <br /> <br />Staff recommends approval of the 440 Park Court conditional use permit and site & <br />building plan review subject to following conditions: <br /> <br />1. Permitted uses listed in City Code Section 1007.120(7), LI, Light Industrial zoning <br />district shall be allowed to operate in the multi-tenant industrial building units. <br />2. Conditional uses as listed in City Code Section 1007.120(9), LI, Light Industrial <br />zoning district shall not be allowed to operate in the multi-tenant industrial <br />building units. <br />3. Indoor self-storage or storage of personal items in the multi-tenant industrial <br />building units shall not be allowed. <br />4. The Phase I-Lino Lake Storage mini self-storage facility and Phase II multi-tenant <br />industrial and indoor self-storage building shall be operated as a single business <br />or enterprise as required per City Code Section 1007.120(9)(g). <br />5. A Parking Deferment Agreement shall be recorded. <br />a. If the proof of parking area is constructed in the future, the parking <br />spaces in front of the west unit shall be striped “No Parking” to allow for a <br />24ft wide drive aisle <br />6. A Site Improvement Performance Agreement shall be executed. <br />7. A Declaration for Maintenance of Stormwater Facilities in favor of RCWD and the <br />City shall be recorded. <br />8. A Permanent Drainage and Utility Easement 10ft above the delineated wetland <br />boundary, 10ft above the stormwater pond 100 year HWL, and over the sanitary <br />sewer pipe shall be granted to the City and recorded. <br />9. If installed, rooftop or ground mounted mechanical equipment shall be screened <br />per City Code Section 1007.043(2)(d)14. <br />10. Annual inspections may be conducted by the City to ensure City Code <br />compliance. <br />11. A separate sign permit application shall be submitted and approved by the City <br />prior to any permanent, replacement, or temporary signage installation. <br />12. A building permit for change of use is required for any new tenant that occupies <br />a multi-tenant industrial building unit. <br />13. An Anoka County right-of-way permit is required. <br /> <br />The following items shall be addressed prior to City Council action: <br /> <br />1. All comments from the City Engineer memo dated March 6, 2024. <br />2. All comments from the Environmental Coordinator memo dated March 5, 2024. <br />3. Electronic copies of the following items shall be submitted to the City: <br />a. Geotechnical Report <br />b. RCWD Notice of Decision for wetland delineation <br />c. MPCA RAP Implementation approval letter <br />4. The applicant shall draft the following documents for City review and approval:
