1 <br /> <br />JOINT POWERS AGREEMENT BETWEEN <br />TOWN OF WHITE BEAR AND CITY OF LINO LAKES <br /> <br /> This Agreement is made and entered into this ____ day of __________, 2024 by and <br />between the Town of White Bear, a statutory town under the laws of the State of Minnesota <br />(“Town”) and the City of Lino Lakes, a statutory city under the laws of the State of Minnesota <br />(“City”) <br />RECITALS <br />WHEREAS, Frank Grover and Susan Grover (“Owner”) are the owners of real property <br />situated in the County of Anoka, State of Minnesota, legally described as follows to wit: <br />See attached Exhibit A (“the Property”) <br />PIN: 36-31-22-44-0007 <br /> WHEREAS, the Owner has petitioned the City for connection to municipal water and <br />sanitary sewer services, and; <br /> WHEREAS, the City has informed the Owner that it has no present plans to extend its <br />municipal water and sanitary sewer services to the Property, and; <br /> WHEREAS, it is feasible for the Town to serve the Property through the municipal water <br />and or sanitary sewer services now owned and maintained by the Town. And the City and the <br />Owner are desirous of having the Town service said Property with its municipal water and <br />sanitary sewer services. <br />PURPOSE <br /> Minnesota Statute § 471.59 provides that two or more governmental units by agreement <br />entered into through action of their governing bodies, may jointly or cooperatively exercise any <br />power, to the contracting parties, or any similar powers including those which are the same <br />except for the territorial limits which they are exercised.
