CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 7A <br />STAFF ORIGINATOR: Diane Hankee PE, City Engineer <br />MEETING DATE: June 23, 2025 <br />TOPIC: Phelps Road Stockpile <br />Consider Resolution No. 25-89 Approving Interim <br />Use Permit <br />Consider Resolution No. 25-90 Approving Site <br />Improvement Performance Agreement <br />VOTE REQUIRED: Simple Majority <br />INTRODUCTION <br />City Council is considering the Interim Use Permit for stockpiling material to prepare future <br />industrial sites on property located off Phelps Road (PID #24-31-22-42-0004). <br />BACKGROUND <br />Mark Smith resubmitted a Land Use Application for an interim use permit for earth moving <br />and stockpiling on a property located on Phelps Road (PID #24-31-22-42-0004). The City's <br />Planning and Zoning Board and City Council approved this project back in 2022/2023. The <br />applicant did not move forward with the project at that time and is now seeking approval <br />again. There are no proposed changes to the project. <br />The applicant is requesting approval of an interim use permit to place approximately 71,000 <br />cubic yards (CY) of suitable fill material on the site for use during future industrial <br />development. The stockpiles are proposed to be up to 15 feet higher than the existing grade <br />of the site. Three separate stockpiles are proposed. <br />The following staff report is based on the plan set prepared by Stantec dated December 15, <br />2022, and received by the City on December 15, 2022. <br />ANALYSIS <br />Section 1007.051 of the Zoning Ordinance effective January 5, 2023, establishes requirements <br />for earth moving and land reclamation. Earth removal, land reclamation, material storage, or <br />filling are permitted uses in all zoning districts. An interim use permit is required when 5,000 <br />cubic yards or more of material is planned to be removed or deposited on any lot or parcel. <br />Page 98 of 142 <br />
