Planning & Zoning Board <br />July 10, 2002 <br />Page 6 <br />APPROVED MINUTES <br />Comment: Each use should conform to the spec ific standards listed within the General <br />Business section of the zoning ordinance. Specifically, the day care should meet the <br />requirements listed under Section 7 H(11)(a). <br />Staff indicated The Environmental Board re viewed the proposed development on April <br />24, 2002 and recommended approval. Thei r comments are attached and, where <br />applicable, have been incorp orated into this report. <br />Staff noted the Rice Creek Watershed Distri ct (RCWD) granted a TWAFAA (Table With <br />Authorization For Administration Action) on February 27, 2002, pending resolution of <br />Wetland Conservation Act (WCA) issues. <br />The applicant was proposing to fill 8,000 square feet of existing wetland on the site. <br />3,041 square feet was proposed to be mitigat ed on-site. The a pplicant was currently <br />working with the RCWD to satisfy the remaining mitigation requirements through a <br />comprehensive drainage plan for the site, future Ware Road extension and surrounding <br />properties. The wetland delineat ions had been approved and RCWD had agreed to work <br />with the applicant to create the best so lution for wetland impacts and protection. No <br />permit for the work at Spirit Hills will be issued until the overall impacts were addressed <br />during the Ware Road permitting process. <br />Staff explained a copy of the applicati on had been submitted to Anoka County for <br />review. Their comments, would need to be in corporated into the s ite design. Dedication <br />of access control, along Birch Street, to Anoka County should be shown on the final plat. <br />State noted it was anticipated that impr ovements to the Ware Road/Birch Street <br />intersection, including turn lanes would be required. <br />Staff stated prior to the commencement of a ny site work, the applicant would be required <br />to enter into a performance ag reement with the City and pos t all the necessary securities <br />required by it. <br />Staff stated based on the fi ndings and subject to the c onditions listed below, staff <br />recommended the following: <br />A.Approval of rezoning the site to GB, Gene ral Business and approval of the PDO overlay <br />subject to the following conditions: <br />1. The site and buildings shall be develope d as outlined on the plans dated 3/4/02 <br />and last revised 6/12/02. <br />2. A sidewalk shall be installed along th e frontage of Ware Road and shall be <br />maintained by the commercial development. <br />3. The PDO shall include the CUP’s for the Motor Fuel Station (Convenience <br />Store), Bank Drive-Thru and Day Care subj ect to the requirements of Section 7, <br />Subdivision 3, H(2), H(5) and H(11), respectively of the Lino Lakes Zoning <br />Ordinance.
