Planning & Zoning Board <br />June 13, 2012 <br />Page 3 <br />APPROVED MINUTES <br />2 . This interim use permit is effective for five (5) years from the date of approval by the <br />City Council. It shall be reviewed at that time. The City Council can extend it at the <br />Council’s discretion. Without such extension the permit shall expire. <br /> <br />3. Prior to commencing construction activity authorized by this interim use permit, a <br />p ermit or approval must be obtained from the Rice Creek Watershed District. Any <br />conditions or requirements of the Watershed District approval are included by <br />reference as conditions of this interim use permit. <br /> <br />4 . Stormwater management measures must be imp lemented to the satisfaction of the City <br />Engineer before and during activities authorized by this interim use permit. <br /> <br />5 . This interim use permit shall be recorded against the property. <br /> <br />6. The loading operations of the business are limited to the hours b etween 7:00 A.M. and <br />9:00 P.M. <br /> <br />7. The improvements depicted on the submitted plans shall be completed within 60 days <br />of City Council approval. <br /> <br />Motion was supported by Mr. Evenson . Motion carried 4 - 0 . <br /> <br />B. PUBLIC HEARING to consider Amending Section 8 of the Zoning Ordinance <br />which includes requirements for Industrial Districts <br /> <br />Paul Bengtson presented the staff report. Staff recommended approval of the Zoning <br />Ordinance Amendment . <br /> <br />Board member comments included: <br />• Concern that removing the IUP for outdoor storage would make it harder to <br />enforce if it became an allowable use. <br />• Concern that outside storage was not permitted along interstates, but was <br />permitted next to residential. <br />• A lack of distinction between GI and LI . <br />• Motor fuel stations could be an approp riate use in industrial districts . <br /> <br />Staff addressed questions of the board. Ms. Kendra Lindhal, city consultant from <br />Landform, said that staff changed an IUP to a CUP in the draft ordinance, recognizing <br />that a business with outdoor storage was unlikely to go away . Staff noted that areas where <br />outdoor storage was allowed did not include freeway frontage for aesthetic reasons, since <br />35W and 35E were considered gateways to the community. There is only minor <br />distinction between LI and GI, with LI considered to be more professional, high tech, but <br />the limited amount of GI allows somewhere in the city for heavy manufacturing. Motor <br />fuel stations generally prefer high traffic areas. An industrial company is allowed to have <br />a fuel on site to service trucks. <br />
