Planning & Zoning Board <br />February 10, 2010 <br />Page 4 <br />APPROVED MINUTES <br />Board members agreed that establishments should be responsible for regulating the <br />consumption of liquor on their premise, as they are accountable for their liquor license. <br /> <br />Mr. Smyser stated that, at the advice of the city a ttorney, staff has proposed a new <br />definition of “golf course” to entail all potential elements of a typical golf course. He <br />also noted that “Off-Sale” of liquor as an accessor y use will be removed from the <br />definition. <br /> <br />Staff noted that neighboring cities such as Blaine, Hugo and Shoreview do not have <br />specific requirements for outdoor seating. <br /> <br />Staff agreed to discuss with the city clerk and cit y attorney the possibility of adding a <br />requirement in the liquor code that holds establish ments accountable for control of <br />outdoor consumption. <br /> <br />Mr. Nelson made a MOTION to amend the proposed text by deleting a portion of Section <br />3, Subd. 16, B.2 to read: <br /> <br />2. If alcoholic beverages are served or consumed in th e outdoor area, the proper <br />license required by Chapter 700 of City Code must b e current. <br /> <br />Motion was supported by Mr. Laden. Motion carried 4-1. <br /> <br />Mr. Root made a MOTION to amend the proposed text b y deleting Section 3, Subd. 16, <br />B.3, which restricted the size of the outdoor seati ng area. <br /> <br />Motion was supported by Mr. Nelson. Motion carried 4-0. <br /> <br />Chair Tralle opened the Public Hearing at 7:39 p.m. <br /> <br />There was no one present to speak. <br /> <br />Mr. Root made a MOTION to close the Public Hearing at 7:40 p.m. Motion was <br />supported by Mr. Pogalz. Motion carried 4-0. <br /> <br />Mr. Laden made a MOTION to recommend approval of Am ending the Zoning Ordinance <br />regarding: requirements for outdoor dining and outd oor seating in business zoning <br />districts, and; serving alcoholic beverages and oth er uses in golf courses in Rural, Rural- <br />Executive and Public/Semi-Public zoning districts w ith amendments approved by the <br />board. <br /> <br />Motion was supported by Mr. Nelson.
