- • <br />Marketplace PDO <br />Page 2 <br />1110 franchise retail image for individual tenants and recognition of their national trade dress. <br />These design guidelines are incorporated into the PDO ordinance. <br />Wetland Fill /Mitigation <br />• <br />The Rice Creek Watershed District (RCWD) serves as the Local Government Unit <br />(LGU) under the Wetland Conservation Act (WCA), which regulates the filling or <br />draining of all non - public waters /wetlands. Three (3) wetlands were delineated on the <br />site of which two would be impacted by the proposed development. The RCWD Board <br />of Managers met on the 25th of July to review the applicant's Fill and Mitigation plan. <br />The board approved action to "Table With Authorization for Administrative Approval" <br />(TWAFAA). City staff has since met with the applicant and the Technical Evaluation <br />Panel (TEP) to address concerns. The applicant is currently modifying the drainage <br />plans to incorporate comments received at the meeting. <br />Access /Circulation <br />Access to the site is provided from Lake Drive (C.S.A.H. 23) by the easterly extension of <br />Apollo Drive and a secondary access located at the northwest corner of the site. Each <br />access is proposed to be a full movement, signalized intersection. The Apollo Drive <br />access will require the purchase of an approximately 2 -acre parcel adjacent to the <br />development site. Staff is currently working with the property owner to facilitate this <br />transaction. <br />The second access has been identified, by the developer, as integral to the success of <br />the project. Following council action and subsequent meetings with Anoka County and <br />the applicant, the present location of the access was identified. However, to facilitate <br />traffic movements at this location, Anoka County is requiring the reconstruction of Lake <br />Drive to its ultimate design (four lane with right and left turn lanes) between Apollo and <br />77th Avenue. The design would also include the extension of a center median across <br />the 77th Avenue /Lake Drive intersection, which would limit movements at this location to <br />right -in /right -out. <br />The City's Engineer, TKDA, is currently preparing the feasibility study for the Apollo, <br />Lake Drive, and secondary access improvements. The feasibility study will be <br />presented to the council on August 27th. Approximately 200 feet of the secondary <br />access is being proposed as a public road to allow access to the Schwan's property, <br />located directly to the north. <br />Parking <br />Parking within the development is in conformance with city requirements. However, a <br />proof of parking area, consisting of 36 spaces is depicted on the north side of Kohl's. <br />The intent is to construct this parking area with the future 20,000 square foot Kohl's <br />addition. Given that the proposed Kohl's parking already exceeds the City's parking <br />• requirements and the proof of parking area encroaches into proposed green space <br />area, staff is recommending that the 36 parking spaces be removed. <br />
