DEPARTMENT OF THE ARMY
ST. PAUL DISTRICT. CORPS OF ENGINEERS
190 FIFTH STREET EAST
ST. PAUL, MN 56101-1638
arm December 18, 2003
AUSm0N ON
Construction - Operations
Regulatory (04- 01360 -TJF)
Mr. Mike Grochala
City of Lino Lakes
600 Town Center Parkway
Lino Lakes, Minnesota $5014
Dear Mr. Grochala:
We have reviewed. the Environmental Assessment Worksheet
(EAW) that was prepared for a project in Lino. Lakes called the
Legacy at Wood's Edge ... Development rights for portions of the
site have been acquired. by The Hartford Group. The project site
is in the southeast quadrant of I35W and Lake Drive in the NE 1/4
Sec. 17, T. 31N., R. 22W., Anoka County, Minnesota.
The EAW indicates that wetland areas on the site :would be
preserved. The Corps of Engineers, regulates -the discharge of
dredged and fill material into waters and wetlands under Section
404 of the Clean Water Act. If the project involves no work. in
any waters - or wetlands a permit will not be required from the
Corps.
We understand a wetland delineation has been conducted; and
the development would not require any work within any waters or
wetlands. This delineation should be verified by the Corps or
the Rice Creek Watershed District. Also, all wetlands should be
clearly staked in the field to avoid inadvertent encroachment
during construction.
If you have any questions, contact Timothy J. Fell in our
St. Paul office at (651) 290 -5360. In any correspondence or
inquiries, please refer to the Regulatory number shown above.
Sincerely,
Ede
bert J. hiting
Chief, Regulatory Branch
CF: RCWD.
1
RESPONSE
1 Prior to the commencement of construction activities, wetland boundaries will be staked and reviewed by the
Rice Creek Watershed District.
•
