Eagle Brook Church <br />page 6 <br />Heron Rookery and Conservation Easement: The second largest heron rookery in <br />the Metro area is on the island in Peltier Lake. The proposed church building pad is <br />approximately 3000' from the island. The proposed septic system and stormwater pond <br />are about 2000' from the island. (One mile equals 5280 feet.) <br />The birds forage for nesting material on the shores of the project property. The church <br />has agreed to cooperate with environmental groups, including the Mn DNR and Anoka <br />County Parks, to manage the shore area in a way that supports the foraging activity. The <br />church is proposing a conservation easement in the southwest part of the property. This <br />would include the wetland area there as well as land between the wetland and the lake. <br />Terms of the easement agreement would involve maintaining the area for foraging as <br />well as restoring part of the area to a native prairie as well as attempts to eliminate <br />invasive species in the wooded wetland areas. As proposed, the easement will be granted <br />to the Rice Creek Watershed District. The conservation easement covers about 14 acres. <br />Wastewater System: The proposed wastewater treatment system for the church <br />includes a tank, a pretreatment step, and a mound soil treatment system (drainfield). The <br />City received the assistance of the Anoka County Community Health & Environmental <br />Services Dept. to review the final design of the wastewater treatment system. That <br />department reviewed the preliminary design report and found the design acceptable. <br />With the pretreatment, the proposed system exceeds the requirements of the state and the <br />county. (Lino Lakes does not have its own septic system requirements: the City is <br />therefore required to adhere to the Anoka County regulations.) With the pretreatment, <br />effluent from the proposed system will be better than the standard septic system utilized <br />by others in the area. <br />Because of the distance between the building and the tank, the pipe must be insulated to <br />prevent freezing. The pretreatment element area and the mound should be protected from <br />snowmobiles and ATVs with a fence. We can add these as conditions of approval. <br />Even though a new system was installed on Lot 2 in 1993, we still require a site for a <br />secondary system in the event the first one fails. The preliminary plat shows the <br />locations of the existing septic system drainfield and an area for a secondary drainfield on <br />Lot 2. MPCA rules (MN Rule 7080) state there must be a 10' setback from property <br />lines and 100' from the well. The proposal meets the setback requirements. <br />In the event that public sewer is available in the project area, it would be best for the <br />church to connect. At this time, there are no proposals to extend public sewer or water to <br />the area. It is always a good idea for any property owner to consider such a future <br />connection when designing a site. The utility plan includes locations for future water and <br />sanitary sewer connections. <br />The City supports designing for a future connection. The City may require a condition of <br />approval, as part of the conditional use permit, that the church connect to a public sewer <br />within 24 months of the public system becoming available. <br />Resolution 04 -17, page 6 <br />
