March 19, 2003 <br />Dear Mayor and Members of the City Council: <br />The HERON Group still hopes that you will turn down the request for a <br />conditional use permit for Eagle Brook Church North Campus, since it is too large, <br />too intense, and will generate too much traffic for the roads to handle. We also <br />realize that you might grant the conditional use permit. In the event that you do <br />decide to grant it, we would appreciate your including additional conditions that <br />further define the permitted activities and protect the herons. We have drafted <br />these below. <br />1. Protect and support the Blue Heron Rookery. <br />a. The proposed conservation easement must be legally in place before any <br />grading or building permit would be granted. <br />b. The church would prohibit any human activity within the conservation <br />easement during the heron nesting season, which is defined as between April <br />1 through August 1 of each year. One exception: observation by County <br />and State naturalists may be allowed. <br />c. The church will prohibit all boats and church member activities on the lake <br />or at the shore, including that part outside the conservation easement, during <br />the heron nesting season. <br />d. Sound disturbance prevention: No horn blowing from the congregate, <br />including weddings. No outdoor amplification from any location on the <br />property. <br />2. Traffic Safety <br />a. A right turn lane off of the Interstate 35 -east north exit ramp must be <br />constructed prior to the issuance of an occupancy permit for the church. The <br />church will pay the cost of constructing this lane. <br />b. The City will set up a review panel to make quarterly reviews of the Eagle <br />Brook traffic impact and conditions created by the church's events and <br />services. The . review panel membership would consist of non - church <br />members from the Lino Lakes and Centennial Lakes police departments, a <br />non- church member from the Washington County Sheriff Department, a <br />Heron Group representative and an Eagle Brook representative. All safety <br />action recommendations would be sent to the appropriate city or county <br />entity. <br />c. The Lino Lakes chief of police, or his designee, will decide when and where <br />traffic control officers are needed. At a minimum, any church activity which <br />is expected to attract more than 1250 attendees during any 30- minute period, <br />
