DRAFT <br />MEMORANDUM OF UNDERSTANDING <br />CITY OF LINO LADS <br />AND <br />INTERNATIONAL UNION OF OPERATING ENGINEERS <br />LOCAL 49, AFL -CIO <br />CONTRACT EXTENSION & FURLOUGH PLAN <br />This MEMORANDUM OF UNDERSTANDING is entered into by the EMPLOYER, and the <br />UNION for the purpose of extending the AGREEMENT dated 1 January 2008 — 31 December <br />2009. <br />The EMPLOYER and UNION agree to extend the terms and conditions of employment with the <br />modifications outlined in this AGREEMENT. <br />FURLOUGH PLAN: The EMPLOYER and UNION agree to an Eighty (80) Hour unpaid <br />furlough for the calendar year 2010. Furlough days will be in increments of four (4) Hours and <br />will be used at the discretion of the EMPLOYEE upon approval of the EMPLOYER No more <br />than three (3) Furlough Days may be taken in one week. One half of the unpaid leave hours <br />must be taken by 15 July 2010. <br />BENEFITS: There will be no change in benefits or loss of accrued leave time due to the <br />EMPLOYEE taking furlough days. There will be no changes in seniority. <br />PERA: EMPLOYEES may buy back PERA credits for lost wages with the EMPLOYER <br />contributing the employer's portion. <br />PAYROLL: EMPLOYEES will mark furlough days on timecards and pay will be deducted on <br />an as taken basis. <br />UNION SECURITY: The EMPLOYER agrees to maintain 16 bargaining unit members for <br />2010 except if there is a reduction due to attrition. <br />MONITORING: The UNION will have access to the Finance Director in mid -July to discuss <br />City financial affairs and the EMPLOYER'S determination of the financial necessity of the <br />second half of the unpaid leave hours. <br />• <br />• <br />
