Staff noted the Zoning Ordinance allowed for such placement of an accessory <br />building in the Rural zone, but stipulated that it should be set back from the street right- <br />of-way at least 100 feet. The proposed ga rage could only accommodate a setback of 58 <br />feet, however, due to the location of the septic system, so the appli cants were requesting a <br />variance. Staff reviewed the five findings of fact for a variance and indi cated hardship <br />could be demonstrated in this instance by the location of the septic system. Staff stated <br />the septic mound precluded the proposed garage from being sited in an area that would <br />satisfy ordinance requirements. In this wa y, hardship could be demonstrated and staff <br />would recommend approval of the requested variance. <br />Chair Schaps invited appl icant to make comment. <br />George Fernstrom, 6340 Red Maple Lane, stated their septic system failed last year and <br />was replaced. He stated they now wanted to put in a garage, but the septic system was in <br />the way. He noted no neighbors had expressed concerns or objected to this proposal. <br />Mr. Rafferty made a MOTION to recomme nd approval of a variance for a second, <br />detached garage with a setback of 58 f eet, as outlined by staff’s August 13, 2003 report <br />and was supported by Ms. Lane. Motion carried 5-0. <br />B.PUBLIC HEARING – Bruggeman Propert ies, SE Corner of Birch St. and <br />Hodgson Road., Rezone, Preliminary Plat/Planned Unit Development, <br />Conditional Use Permit <br />Chair Schaps opened the public hearing at 6:44 p.m. <br />Staff reviewed their August 13, 2003 report a nd reviewed the unresolved issues that <br />needed to be addressed further. <br />Staff recommended continuing the public hear ing or close the public hearing and table <br />the application to allow for resolution of the issues. <br />Mr. Lyden asked how much increase in traffic would there be from Hodgson Road north <br />of County Road J. Mr. Smyser replied there would be 152 homes <br />Mr. Lyden pointed out that there was the pos sibility of 500-600 addi tional traffic trips a <br />day. Mr. Smyser noted the problem with th e intersection was at the peak hours, not <br />generally during the day. <br />Mr. Lyden stated he disagreed with the traffi c figures staff was givi ng. He believed there <br />would be more than 28 cars ad ded to this intersection. <br />Mr. Rafferty asked if there would be a tra ffic light at Ware and Birch. Mr. Smyser <br />replied that was correct. <br />Mr. Tralle asked when were the road im provements proposed to be done. Mr. Smyser <br />replied the road improvements would have to be done as a part of this project.
