The site will be paved according to typical City requirements. <br />g. The drainage of the area must meet City requirements, including the AUAR mitigation <br />plan. <br />h. Lighting effects on abutting residential properties is not an issue on this site, but lighting <br />fixtures must meet City requirements. <br />i. Vehicular access to the car wash is throngh the gas station site. There are no car wash <br />access problems. <br />j. The site is next to an interstate freeway and an interchange with county state aid highway. <br />Car wash noise is not an issue. <br />Outdoor Seating, Lot 2, Block 1 (McDonald's) and Lot 2, Block 2 (retail building): The <br />Zoning Ordinance requires a CUP for "restaurants with accessory outdoor dining facilities" in <br />Section 7, Subd. 3.H.12. The ordinance does not distinguish between outdoor seating areas <br />where full service is provided at the tables and outdoor seating where the patrons purchase <br />food inside and bring it outside and eat. However, it is pretty clear that the requirements are <br />intended for areas with wait service and possible liquor sales. The report for the December <br />meeting of the P & Z included this issue and recommended that the P & Z discuss the CUP <br />requirements just to ensure the issues are formally considered and addressed. The Board <br />recommended that the City should not require conditional use permits for outdoor seating that <br />does not include waiter /waitress service. Staff supports this recommendation. This is a <br />clarification that should be made in the Zoning Ordinance, and we can address that when we <br />do some major ordinance revisions in the near future. <br />If there are questions about this approach for the time being, it is allowable under a Planned <br />Unit Development, which is intended to promote "a desirable and creative environment that <br />might be prevented through the strict application of City zoning and subdivision regulations." <br />ENVIRONMENTAL BOARD ACTION <br />Stormwater management was the focus of the Environmental Board discussion on July 25 and <br />again on November 28. This included the importance of the design of the stormwater <br />facilities, such as infiltration and filtration features, and the AUAR requirement for volume <br />control. There also was consideration of revising the landscape plan to substitute some tree <br />species and ensure plantings in infiltration areas are appropriate. The Environmental <br />Coordinator reviewed the revised plans submitted January 24. The comments are attached <br />and have been incorporated into the conditions of approval. <br />PLANNING & ZONING BOARD <br />The P & Z opened the public hearing on December 12, 2007, continued it, and completed it <br />on January 9, 2008.
