• forecasts and a traffic analysis, it is not possible to address the effects of <br />• <br />• <br />additional traffic on local roads. <br />• "Public utilities and services are adequate." (See Engineer's comments <br />Attachment 1.) There are no major issues related to water and sewer capacity <br />associated with the proposed development. However, this area is not currently in <br />the City's Metropolitan Urban Service Area (MUSA), although it is guided as <br />"Growth Area 1998 - 2010" in the City's Comprehensive Plan. Approval by the <br />City to allocate 38 acres of commercial/industrial MUSA will be required <br />before the project can proceed. <br />• "For each additional story over the District limitation or for each additional ten <br />(10) feet above the maximum allowed per District, front and side yard setback <br />requirements shall be increased by ten (10) percent. See "Setback Requirements." <br />• "The construction does not limit solar access to abutting and/or neighboring <br />properties..." The Applicant has provided a detailed shadow study that illustrates <br />the length and position of shadows at different times of the day in different <br />seasons. Based on this analysis, shadows will extend beyond the property line to <br />the east and north in January, April and October. However, since the neighboring <br />land use to the east is I -35E, the shadows will not impede solar access needs on <br />the freeway. There are no impacts to neighboring properties that might desire <br />to employ solar power for their residences or businesses. <br />• "The provisions of Section 2, Subd 2. of this Ordinance are satisfactorily met." <br />These provisions lay out the process for project review and standards, which <br />include consistency with the Lino Lakes Comprehensive Plan. The areas of the <br />Plan to be considered include: Land Use Plan, Transportation Plan, Utility Plans, <br />Local Water Management Plan, Capital Improvement Plan, Policy Plan, and <br />Natural Environment Plan. This Proposal generally meets the requirements of <br />the City's Comprehensive Plan and improves the capital improvement <br />position of the city with the Applicant's Proposal to construct 21st Avenue <br />and Cedar Street. A Joint Powers Agreement between the Cities of Lino <br />Lakes and Centerville will need to be created. <br />Landscaping <br />With the exception of the immediate vicinity of the proposed structure and the parking <br />lot, the Landscaping Plan is limited in the area and scope of landscaping. More detail on <br />the Landscaping Plan should be provided, at least in an area comparable to the 40 -foot <br />buffer area of the building. <br />Section 3, Subd 5 (o) (1) states that parking areas of six (6) or more required spaces shall <br />be landscaped on all sides in compliance with Section 3, Subd 4 (q). The Landscaping <br />Plan needs to address this requirement. <br />12701 -002 <br />
