• <br />• <br />• <br />Planning & Zoning Board <br />Marshan Lake Industrial Park <br />August 13, 2003 <br />Environmental Assessment Worksheet (EAW). Minnesota Rules Chapter 4410.4300, <br />subpart 14 requires the preparation of an EAW for industrial and commercial projects <br />that exceed a gross floor space threshold of 300,000 sq.ft. for 3rd or 4th class cities. <br />Because subdivision of the property provides the potential for this threshold to be <br />exceeded, an EAW has been prepared. The EAW was reviewed by the City's <br />Environmental Board on July 30t , and approved by the City Council for distribution and <br />comment on July 14, 2003. The required 30 -day public comment period ends on August <br />21St <br />Minnesota Statute 16D.04 prohibits final decisions on a proposed project until a negative <br />declaration on the need for an Environmental Impact Statement (EIS) is made. A copy of <br />the EAW is attached to this report. <br />Rice Creek Watershed District (RCWD). A RCWD Land Development permit is <br />required for the proposed project. The project is scheduled to be reviewed by the RCWD <br />Board on August 13th. <br />Anoka County. Plans have been forwarded to Anoka County for review. An Anoka <br />County access permit onto Lake Drive for the proposed roadway will be required. It is <br />also likely the County will require the dedication of right -of -way along Lake Drive, <br />dedication of access control for Lot 1 and Lot 4 that abut Lake Drive, and turn lane <br />improvements to Lake Drive. Conditions of approval will include the requirements set <br />forth by Anoka County. <br />Tree Preservation. A Tree Inventory and Preservation Plan were submitted. However, <br />the preservation plan does not identify trees to be removed as part of the project. Based <br />on the grading plan submitted, the majority of trees on the interior of the property will be <br />removed. It does appear, however, that the majority of trees located adjacent to County <br />Ditch Ten and within the proposed 100 -foot easement can be preserved. A revised <br />Preservation Plan shall be submitted identifying trees to be preserved and methods of <br />protection. Such plans will be subject to review and approval by the City's <br />Environmental Specialist. <br />Landscaping/Buffer. The Lino Lakes Zoning Ordinance (Sec. 3, subd. 4.Q.1 & Sec. 8, <br />subd. 1.F) specifies that a landscape buffer should be provided along side or rear lot lines <br />for sites located in the Light Industrial District which abut residential or commercial <br />districts or road right -of -ways. Such a strip should be at least 40 feet in width and result <br />in 80% opacity. Lots 1, 2, and 4 are subject to this requirement. <br />The existing features that will be preserved on the north side of Lot 2, bordering County <br />Ditch Ten, will satisfy this requirement. The eastern side of Lot 2 includes a 12 -foot rise <br />in elevation over the proposed building floor elevation which will, in conjunction with <br />landscaping required as part of site development approvals, result in adequate buffering <br />of the site. <br />
