E <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: August 11, 2004 <br />TOPIC: Preliminary Plat <br />Fox Den Acres <br />BACKGROUND <br />Royal Oaks Realty has requested approval of single family residential development called Fox <br />Den Acres. This is a new submittal of a plan that is different from the previous design reviewed <br />several months ago. The comprehensive plan guides the site for low density residential use and <br />it is zoned R -1. The site is in the existing MUSA. <br />A public hearing is required for a preliminary plat. Unfortunately, staff neglected to publish a <br />public hearing notice for this meeting. This was an accidental oversight by City staff, for which <br />we apologize. We will publish the public hearing notice for the September meeting. <br />We typically do not recommend approval until we receive the preliminary approval by the Rice <br />Creek Watershed District. We have not received Watershed approval for this project. In <br />addition, there are some design issues that must be addressed. Therefore, staff would be <br />recommending continuing the project to the September meeting. <br />The City soon will approve a new "Parks, Natural Open Space /Greenways and Trails System <br />Plan." Creating greenways is the first priority of the plan. This will require the use of a variety <br />of strategies, the most important of which is greater reliance on a conservation development <br />approach to land development. <br />The comprehensive plan envisions a conceptual greenway along this south and east edge of this <br />site. This project could be a good example of conservation development with some minor, <br />though important revisions. This will require the cooperation of the City, the developer, and the <br />Rice Creek Watershed District. Staff is discussing with the Watershed District how best to <br />pursuit a conservation development on this project. The developer is not yet convinced that such <br />an approach is advantageous or worthwhile. <br />
