• <br />Planning & Zoning Board <br />December 14, 2005 <br />Page 5 <br />Vice Chair Tralle invited anyone for or against this proposal to make comment. <br />John Freimeth, 7381 John Ave, stated he had a concern with respect to the berm and <br />screening. He requested those be constructed all of the way to Apollo before the building <br />was constructed and the berm and screening be located 20 feet off of the street. <br />Vice Chair Tralle asked if Summit had completed their berm. Mr. Bengston responded <br />Summit was deficient on the height of their berm and was also deficient on their <br />landscaping. He indicated staff would contact Summit regarding this. <br />Mr. Freimeth asked if there would be large doors facing Jon Avenue. Mr. Cashman <br />responded doors would be located on the east and west side of the building and that was <br />why they were putting in the berming. <br />Mr. Freimeth stated he wanted the screening that went in there to be adequate and noted <br />it was very noisy in the area and he has had to put up with the noise for five years. Mr. <br />Cashman noted the berm would be built when they were grading, but it would not be <br />totally built until they were done with their construction. He indicated they wanted to <br />build the berm with the materials on site. <br />Mr. Freimeth asked if the doors could be kept closed during the day to reduce some of the <br />noise and only be open when a vehicle was entering or exiting. <br />Vice Chair Tralle asked if they would have the berm completed before they received their <br />Certificate of Occupancy. Mr. Cashman replied they would have no problem with that. <br />Mr. Laden made a MOTION to close the public hearing at 7:21 p.m. and was supported <br />by Mr. Rafferty. Motion carried 5 -0. <br />Mr. Nelson requested adding a condition 10 stating that the berm must be completed <br />before the Certificate of Occupancy is issued. Mr. Cashman stated they would like some <br />flexibility with completing the landscaping in the event of inclement weather, which <br />would preclude the landscaping being completed at the same time as the berm. <br />Mr. Rafferty stated he wanted the trash enclosure to be attached on the north side of the <br />building and requested staff work with the applicant regarding this. <br />Mr. Rafferty made a MOTION to recommend a Conditional User Permit to allow an <br />automobile and truck repair facility, Pomp's Tire, to be located at 7385 Apollo Court <br />subject to the conditions as noted in staff's December 14, 2005 report and adding <br />condition 10 that the berm must be completed before the Certificate of Occupancy is <br />issued and revising condition 4 to have the trash enclosure on the north side of the <br />building and was supported by Mr. Hyden.
