He would like this project continued at <br />the next meeting and in the meantime work with staff to address staff concerns. He <br />requested revisions to the roof layout of the proposed town homes and asked for a <br />submittal of colored elevations at a future meeting. <br />Mr. Hyden was concerned about safety when streets are offset. <br />Mr. Hyden made a MOTION to continue the Public Hearing for the Rezone, Preliminary <br />Plat and MUSA Allocation for Pheasant Stroll Estates to the April 12, 2006 meeting. <br />Motion was supported by Mr. Nelson. Motion carried 6 - 0. <br />D. PUBLIC HEARING for a Conditional Use Permit to allow for accessory drive - <br />through and outdoor dining facilities for Miller's Crossroads Shopping Center <br />Mr. Smyser presented the staff report. <br />Chair Rafferty opened the Public Hearing at 8:08 p.m. <br />Mr. Smyser clarified that the Public Hearing is for the drive - through and outdoor dining <br />only, not for building design approvals. <br />Mr. Smyser confirmed that the proposed trash area is enclosed and that the peak parking <br />issue has been resolved since the staff report was written. Staff will require more <br />information about the retaining wall. Mr. Smyser clarified that the outdoor seating will <br />only be accessible from inside the coffee shop, as per CUP requirements. <br />Staff stated that they received two emailed comments that will be part of the public <br />record, as were distributed to the board prior to the mtg. <br />Staff is recommending approval. <br />Robert Bayer, 6490 Hokah Drive, owner of CuppaJo's coffee shop at 6505 Ware Road, <br />stated that he believes the city should help local businesses succeed. He stated that <br />allowing this coffee shop would have a negative impact on his shop as well as the entire <br />Spirit Hills Center. He believes a traffic study is warranted to allow for a Conditional <br />Use Permit. Mr. Bayer pointed out there are current problems with existing traffic <br />backup on Birch St., as well as trying to exit off of Ware Road onto Birch Street. He <br />added that many accidents have occurred at the intersections of Hokah Dr., Birch St., and <br />Ware Rd. <br />Katie Allen, 3890 88th Court NE expressed concern about traffic. She stated that an <br />additional coffee shop with a drive - through will increase traffic onto Birch St. She <br />requested an improvement to the intersection at Spirit Hills, possibly signals, to decrease <br />traffic problems. She asked that this item be tabled in order to address increasing traffic <br />issues on Birch St. <br />DRAFT MINUTES <br />
