• <br />• <br />• <br />Planning & Zoning Board <br />May 10, 2006 <br />Page 3 <br />Mr. Laden made a MOTION to recommend approval of the Planned Unit Development <br />Final Plan for Legacy Townhomes, subject to the following conditions: <br />1. The developer will enter into a development agreement with the city prior to the <br />issuance of any building permits for the site. <br />2. A minimum 2 inch deep window trim or two inch recess must be provided in <br />accordance with the development standards for the site. <br />3. All lighting fixtures must be submitted and prove to be in conformance with the <br />requirements of the LLTCDDG. <br />4. Issues discussed in the S.E.H. engineering review letter must be addressed to the <br />satisfaction of city staff. <br />5. Operation and maintenance agreements for the site, including provisions for <br />stormwater facilities, must be submitted for review by city staff prior to the issuance <br />of building permits. <br />6. Homeowner's association documents must be submitted prior to the city releasing the <br />plat for recordation. <br />7. The applicant shall provide a bicycle parking area sufficient in size to accommodate <br />an appropriate number of bicycles. The type of fixture provided and the location of <br />this parking area must be reviewed and approved by staff prior to the issuance of <br />building permits for the site. <br />8. All landscaped and sodded areas must be irrigated. <br />9. All ground mounted utility equipment shall be completely screened from view with <br />appropriate landscaping materials. <br />10. All roof mounted equipment shall be completely screened from view. This screening <br />shall be constructed of materials consistent with those used for the main building. <br />11. The mailboxes proposed for the development must be reviewed and approved by staff <br />prior to the issuance of building permits for the site. Such mailboxes shall be <br />screened with complementary materials to those of the main structures. <br />12. The developer is encouraged to wrap the corners of buildings with the patio areas of <br />the end units. <br />13. The final plat for the buildings on the east side of the site, which have drives leading <br />to the garages shall include a limited common element for those drives to prohibit <br />other townhome owners from parking within the drive of another townhome. <br />14. The six parking spaces shown on the site plan closest to Town Center Parkway and <br />Village Drive shall be eliminated and replaced with additional landscaping materials. <br />15. The appropriate access easements for the ponds will be granted to the city for <br />maintenance purposes. <br />DRAFT MINUTES <br />
