The city cannot merge two pieces of land if one <br />piece is designated PSP, so this was an unanticipated problem. <br />Mr. Farmerie stated that currently the strips of land between them and the lake have been <br />offered only to the adjacent property owners, but asked if someone else could possibly <br />come and buy a parcel. Mr. Bengtson replied that staff recommended a condition that the <br />parcels would only be available for sale to the adjacent property owner. The intent of the <br />St. Paul Regional Water Services is to sell the parcels to the adjacent properties only. <br />Mr. Rafferty asked for clarification on the lot combination procedure and if St. Paul <br />Regional Water Services will maintain parcels not adjacent to developed land. Staff <br />clarified the process and explained that the St. Paul Regional Water Services would <br />continue to hold parcels not sold to adjacent property owners. <br />Mike Mastro, 1553 Lamotte Dr., stated that there is a 60 -foot outlot next to his property <br />which has a city -owned drainage ditch that needs to be attended to. He noted that the city <br />also has property adjacent to the Regional Water Services property. He stated that he <br />currently has sole rights of the use of the adjacent property through an insurance policy <br />and an annual dockage fee. He wondered if he owned the property, would those <br />obligations go away. Mr. Mastro was informed that the property owner will own the <br />parcels and St. Paul Water Services will have access only. He was informed that many <br />other communities have done this. <br />Mr. Mastro said that he heard there would be a fee through this process. Mr. Bengtson <br />explained that this is not the last step in the process. The proposal would go to the <br />Metropolitan Council, and a minor subdivision would need to be done administratively to <br />divide the property. St. Paul Water Services would be the applicant and would have to <br />establish an escrow account for staff review. Staff is not aware if the regional water <br />services will ask property owners for money. Ultimately, the properties will need to be <br />combined with adjoining parcels. <br />Mr. Mastro stated that he has already given the regional water services his application <br />and fees. <br />Gerry Lindner, 7413 Peltier Lake Dr., stated that he does not want a trail to come <br />between him and the lake. Mr. Bengtson stated that this is not in any way a discussion of <br />a trail location, and that the city's trail plan indicates a trail in a theoretical location. Mr. <br />Lindner wanted it stated for the record that he does not want a trail across his land. Mr. <br />Lindner said that the St. Paul Regional Water Services asked him to pay to survey his <br />land and he was wondering if the city was going to help pay the costs for surveying. Mr. <br />Bengston responded that the city does not pay for property owners to have their <br />properties surveyed. It was suggested that it may be more cost effective if multiple <br />properties would be surveyed at once. <br />Mr. Farmerie asked about the fees associated with the next step of the process. Mr. <br />Bengtson explained that fees would be required and it is up to the applicant to work out <br />who pays for those fees. <br />DRAFT MINUTES <br />
