• <br />Section 2 Subds. 1. — 9. DRAFT AMENDMENTS May 2011 <br />SECTION 2. ADMINISTRATION <br />Subd. 1. - Zoning Amendments (Text and Rezonings). In <br />accordance with the provisions of Minnesota Statutes, the City Council may from time <br />to time amend the Zoning Ordinance text or map (rezoning). Amendments may be <br />initiated by City Council, Planning and Zoning Board, or property owner. The procedure <br />for an amendment to the Zoning Ordinance text or Zoning District Map (rezone) shall be <br />as follows: <br />A. Persons wishing to initiate an amendment shall submit a "Land Use Application <br />Form" accompanied by a fee as required in Section 1, Subd. 1.1. of this <br />ordinance to be used for the costs of processing the application. The Land Use <br />Application Form shall be filed with the Zoning Administrator. The request for <br />amendment shall be placed on the agenda of the Planning and Zoning Board <br />according to the City's deadline and meeting schedule. The request shall be <br />considered officially submitted and the application approval time line commences <br />when all the information requirements are complied with. <br />B. Property owners or occupants within six hundred (600) feet of any property <br />• proposed for zoning district amendment (rezoning) shall be notified in writing, <br />although failure by any property owner to receive notification shall not invalidate <br />the proceedings, provided that proof of an attempt at notification has been made. <br />Notification shall be by first -class mail. A notice shall be published in the <br />newspaper and mailed to property owners at least ten (10) days prior to the day <br />of the public hearing. Such notification shall include the Affidavit of Mailing <br />completed by the City and a list of all persons who have been notified pursuant <br />to this section. In the case of rezoning shoreland, as defined by Lino Lakes <br />Ordinance, all property owners or occupants of property, which abut the <br />shoreline, shall be notified in writing of any property proposed for any zoning <br />district amendment (rezoning), even though their property may be beyond the six <br />hundred (600) feet previously contemplated in this section. <br />C. Depending on the project and as determined by the Community Development <br />Director, either the following information shall be provided prior to Planning and <br />Zoning Board review: site and building plans consistent with the requirements <br />established in Section 2, Subd. 6., information required for a Planned Unit <br />Development as required by Sec. 2 Subd. 10, er- -information required by <br />Chapter 1.000^ 1001 of the City Code for a plat submittal, shalle- premed prier <br />tePlanning- Z hoard review or a description of the requested change in <br />the case of a text amendment. <br />Lino Lakes Zoning Ordinance Administration <br />Amended per Ord.
