Mr. Jeff Smyser <br />December 13, 2006 <br />Page 4 <br />Progress to Date <br />CORE's submission of its development application for the Site is the next step in the <br />development and re- development of the Hodgson / County Road J area. It provides the City with <br />development details for the Site, as well as insight to the future development and redevelopment <br />of the entire Study Area. <br />Consistency with the Underlying Zoning <br />The underlying zoning of the Site is General Business. By statute, the City's Zoning Ordinance <br />implements the policies of the approved Comprehensive Plan. Minn. Stat. § 473.851(9). The <br />proposed PUD Zoning Ordinance for Comforts of Home will, therefore, implement the policies <br />established in the related Comprehensive Plan for the area located within the Hodgson Road / <br />County Road Study Area. Minn. Stat. § 473.858(1). <br />The City reports in its December 8, 2006 draft of the Hodgson Road / County Road J Master <br />Plan the following: <br />General Business zoning includes a wide variety of businesses including retail, service <br />and semi - industrial uses. They may contain businesses which tend to serve other <br />business and industry as well as those catering to shoppers' needs. Draft Master <br />Planning Study / Hodgson Road and County Road J, December 8, 2006, p.8. <br />The proposed mix of uses within the 17 -acre Comforts of Home planned unit development is <br />consistent with the overall intent of the general business zoning. <br />Consistency with the Comprehensive Plan <br />The City's Comprehensive Plan guides the Site as Mixed Use. The City describes the intent of <br />the Mixed Use land use category as follows. <br />The Mixed Use designation is intended to accommodate development that includes a <br />variety of land uses. This could be a development that integrates uses in the same <br />building, such as residential units above commercial space. It also might include <br />different uses in separate elements of a larger development, as part of a master plan. <br />2002 Lino Lakes Comprehensive Plan, p. 97. <br />The proposed Comforts of Home development is consistent with the intent of the City's Mixed <br />Use designation. In addition, the underlying zoning supports many of the proposed uses within <br />the CORE submittal. <br />Compatibility with the Draft Master Planning Study / Hodgson Road and County Road J <br />The City has been proactive in planning for the future of the Hodgson Road / County Road J <br />area. The City states that the "Master Plan is intended to show a general land use arrangement <br />with some specific design elements.
