RECOMMENDATION: <br />Staff recommends approval of the proposed preliminary plat, conditional use permits, and site plan review <br />subject to the following conditions: <br />• <br />1. The existing Conditional Use Permit is hereby amended to allow the existing facility to complete <br />improvements necessitated by the city's Lake Drive /Town Center Parkway improvements and to allow <br />for the installation of two additional gasoline pumps. This amendment will remove condition numbers <br />4, 5.3, 5.4, 5.5, and 9 from the 1999 approval and is otherwise limited to the following changes: <br />a. No fence will be required on the southern property line and no additional landscaping will be <br />required to install the two additional pump islands. <br />b. The curbing and parking area may be relocated to allow proper access to the new drive off of <br />Town Center Parkway. <br />c. The existing pylon sign on Lake Drive may be relocated as shown on the plan. <br />d. The access drive on the south side of the Lake Drive frontage must be removed. <br />e. The Conditional Use Permit shall not longer apply to the land hereby platted as Lot 2. <br />2. The Conditional Use Permits for a Motor Fuel Station and Automatic Car Wash shall apply only to Loll) <br />1 as shown on the Preliminary Plat. <br />3. The deadline for construction of the facility allowed by the approval of the Conditional Use Permits and <br />Site Plan Review will not begin until the completion of the Town Center Parkway improvements. <br />4. Upon construction of the new facility the existing Conditional Use Permit shall be voided and the <br />Conditional Use Permits approved as part of this review will be enforced. <br />5. Issues discussed in the City Engineer review memo must be addressed to his satisfaction prior to the <br />issuance of any building permits for the site. <br />6. The developer must enter into a site performance and stormwater maintenance agreement with the city <br />prior to the issuance of any building permits for the site. <br />7. The preliminary plat must be revised to provide the following: <br />a. Reference the parcel identification established for the Lake Drive and Town Center Parkway <br />right of way by Right of Way Plat #3. <br />b. The developer must convey to the city the appropriate drainage and utility easements along <br />property lines, over the drainage areas, and along utility alignments. <br />c. The developer must deed right of access to Anoka County along the Lake Drive frontage. <br />• <br />
