October 13, 2003 City Council <br />Apollo Center <br />Driveway Access <br />The Zoning Ordinance states that driveways onto arterials and major collectors <br />are prohibited where alternative street access is available. The Comprehensive <br />Plan does not distinguish Lilac Drive as a major collector. For the purposes of <br />this analysis, then, access shall be allowed onto Lilac Street. <br />The Zoning Ordinance requires that curb cuts shall not be located less than 30 <br />feet from the intersection of two (2) or more local or minor street rights -of -way. It <br />further states that curb cut/driveway access shall not be located less than 40 feet <br />from one another. Curb cuts shall be a minimum of five (5) feet from the side <br />yard property line. <br />The proposed curb cut in this development enters approximately 100 feet east of <br />Apollo Drive. The curb cut/driveway as proposed will be approximately 20 feet <br />from the east lot line, which meets the City's standard.The proposal meets the <br />requirements of the Ordinance for curb cuts. <br />Off Street Loading <br />Section 3, Subd. 6. G. states that any structure that requires the receipt or <br />distribution of materials or merchandise by trucks or similar vehicles, off- street <br />loading space shall be provided. The proposed development includes a <br />substantial amount of space devoted to retail, but it is not apparent that loading <br />areas are designed in. <br />In the staff's meeting with the developer and his contractor, the issue of delivery <br />areas was addressed. The contractor, who has developed shopping malls, <br />indicated that for the type of retail that is proposed to be located in this <br />development, most deliveries are made by UPS or other delivery service through <br />the front door. While this may be the case, without knowing the exact makeup of <br />the tenants, it makes sense to designate two stalls in back as truck loading zones <br />for larger deliveries. Loading areas must be designated and included in the <br />design in the rear of the structure. <br />Utilities <br />A utility plan was submitted for review by the City Engineer. Water and sewer <br />service are available to the site. As a condition of plan approval, the utility - <br />related modifications and comments, as set forth in the City Engineer's <br />memo, should be incorporated into the final plans. <br />Stormwater <br />Page 7 <br />
