• <br />Planning & Zoning Board <br />January 13, 1999 <br />Page 3 <br />Mr. Brixius explained that the Planning and Zoning Board reviewed the JADT PDO and <br />Amoco/McDonalds CUP at its October meeting and found the information incomplete. <br />The applicant has submitted additional information addressing issues discussed in the <br />October, 1998, meeting. The applicant wishes to proceed with the first phase of the <br />development and has submitted applications for a PDO, Preliminary Plat, and Conditional <br />Use Permits. <br />Mr. Brixius reviewed the staff report relating to the applications in detail. Mr. Brixius <br />stated that due to changes in land use from the original concept plan, and the applicant's <br />reluctance to establish PDO design guidelines complicated the development application <br />review. Staff recommended the City deny the development application on both JADT <br />and McDonalds. <br />Mr. Tim Baylor, Developer for the project, came forward and reviewed the issues and <br />changes that the staff report indicated. The proposed PDO rezoning is inconsistent with the approved comprehensive Plan <br />Town Center Planning District 1 recommendation. <br />2. The proposed PDO rezoning and development applicant are contrary with the defined <br />design objectives cited by the City in the concept plan approval. <br />3. The proposed Phase 1 land use raises land use compatibility issues related to: <br />a. Duplication of similar land uses at each quadrant of the CSAH 23 /Apollo Drive <br />interchange. <br />• b. Removal of 97 percent of significant trees to accommodate the Amoco/McDonalds <br />development. <br />
