The Police Department building backs onto a <br />residential neighborhood. The site is zoned Neighborhood Business because of the <br />proximity to the residential use. Is this location good for a Legion? Should the area be <br />rezoned somehow? Is there a better location in the City? <br />Mr. Smyser asked for guidance from the Planning and Zoning Board regarding this issue. <br />Mr. Dunn stated the City needs to find a place for them. He indicated the Police Station <br />is not a good place for them at this time. More information is needed. A concept was <br />sold to the citizens that the Police Department area is available for commercial <br />development to get more money on the tax roll. The City must be able to replace that <br />property on the tax roll if the Legion locates there. If a more suitable location is found <br />the zoning could be changed to accommodate the Legion. <br />Mr. Smyser stated the site issue is second. The first issue is how to approach the zoning. <br />Acting Chair Johnson stated that when the zoning code was revised, four business <br />districts were kept. The neighborhood district is the only one tha a akes sense. The <br />other three are overlapping. He suggested the City look at how t siness districts <br />differ regarding uses. He asked if liquor be a conditional those district. One <br />option is to make all of Lake Drive one type of busin; i w performance <br />standards. Certain uses would then require a c• • °@ m •ermit. <br />D. Liquor Ordinance <br />Mr. Smyser stated the City <br />year. The moratori <br />recommendations r <br />ted a moratorium on new liquor licenses last <br />2, 1999. Mr. Smyser reviewed his report and <br />Mr. Dunn stated the e y needs to be flexible with licenses. It is mandatory that liquor <br />licenses be available. An open mind is needed to encourage finer restaurants to locate in <br />the City. <br />Mr. Smyser stated he is preparing a report which was driven by the moratorium. The <br />report will be submitted to the City Council soon. He stated the Board will receive copies <br />of the report. <br />Mr. Dunn stated he agrees with and supports Mr. Smyser's recommendations. He <br />suggested item #1 be clarified that it is a partial allocation. He stated item #6 is an <br />antiquated law. If underage citizens want to try and buy liquor they will do so regardless <br />of how far away the store is from a school. He added that item #7 should also be <br />eliminated. <br />• Mr. Smyser noted that if item #6 is not eliminated a liquor license cannot be issued in the <br />Town Center. <br />
