Motion carried 6 -0. <br />Mr. Dunn made a MOTION to approve the conditional use permit for the civic complex, <br />Town Center Parkway, pursuant to the conditions presented, and was supported by Mr. <br />Johnson. Motion carried 6 -0. <br />B. PUBLIC HEARING, Collova Builders, 250 & 260 Linda Avenue, Rezone, <br />Preliminary Plat and Interim MUSA Reserve <br />Chair Schaps opened the public hearing at 7:12 p.m. <br />Ms. Wyland explained this request by Collova Builders for a rezone, preliminary plat, <br />interim MUSA reserve, and variance for lot depth for the property located on Linda <br />Avenue between Hodgson Road and Lorraine. This property is currently zoned rural, and <br />is outside the MUSA area. This request represents a rearrangement of the July, 1997 <br />approval of a similar request at 250 Linda Avenue, together with the addition of the <br />property located at 260 Linda Avenue. Staff also suggested and published an expansion <br />of this request, which would add Lots 1 and 2, Block 2, Arthur E. Thom Addition, and <br />Lots 47 and 48, Block 1, Arthur E. Thom Addition, such expansion intended to avoid <br />multiple applications in the future. There have been similar inquiries regarding Lot 48. <br />Ms. Wyland added that the current Comprehensive Plan indicates the subject area as <br />single- family residential. Property to the north, east, and west is zoned R -1, and located <br />within the MUSA. Sewer and water utilities are in the street (Linda Avenue) to serve all <br />of these parcels, if requested. The property immediately to the south (Rohavic Oaks) is <br />zoned Rural, with lot areas averaging one acre in size. MUSA reserve for the lots <br />fronting on Linda Avenue would total 5.8 acres. <br />With respect to the preliminary plat, Ms. Wyland explained that this request would create <br />six R -1 single - family building sites from two existing parcels, with lot requirements as <br />follows: <br />Lot width 80 feet <br />Corner lot 100 feet <br />Lot depth 135 feet <br />Lot area 10,800 square feet exclusive of any wetland/watercourse /row <br />All lots meet the minimum frontage and area requirements, with one lot being deficient in <br />depth by 15 feet. Ms. Wyland explained that Staff suggested that Lot 6 could be reduced <br />in width by 30 feet to allow additional depth for Lot 5; however, this may hinder home <br />construction on Lot 6 due to the UPA easement. Should it be determined that the <br />deficiency in depth for Lot 5 is warranted, a variance would be required. <br />
