• <br />Planning & Zoning Board <br />August 14, 1996 <br />Al Robinson made a MOTION to approve the Conditional Use Permit, subject to <br />the conditions listed in the staff report and was supported by Dunn. Motion <br />carried 6 -0. <br />B.96 -27, Birchwood Builders, Deerwood Lane, Country Lakes Estates, <br />Minor Subdivision <br />Ms. Wyland stated that when Country Lakes Estates was developed, Outlot A <br />was required to be dedicated as a drainage easement. It is located off Birch <br />Street at Deerwood Lane. Upon completion of the development, there was <br />enough high land to create another building site. The developer, Mr. Rich <br />Granger, went back to Rice Creek Watershed District and requested permission <br />to change the plan to add another building. Rice Creek Watershed District felt <br />the addition to be acceptable and amended the original permit, rather than <br />requiring a new permit. The property is zoned R -1. Mr. Granger is requesting to <br />split Outlot A into two parcels: 1) a 20,165 square foot buildable lot; and 2) a 2.8 <br />acre outlot. The 20,165 buildable lot exceeds the City code requirement for R -1 <br />District which is 10,800 square feet. The storm sewer pipe will be relocated. <br />Staff recommends approval of this minor subdivision with the condition that the <br />storm sewer relocation be approved by the City Engineer. Also, since the park <br />dedication for Country Estates was a substantial cash dedication, staff is <br />recommending that the park dedication requirement be further reviewed. <br />110 Chair Schaps asked if the street will have to be torn apart and replaced. <br />• <br />Mr. Ahrens responded that only a new manhole will be put in. <br />Chair Schaps asked if there is a significant difference in the size of the proposed <br />lot and the lots already developed. <br />Mr. Granger, 719 Country Lakes Drive, stated that most lots are 80 feet wide <br />and 135 feet deep. The proposed lot is larger because it sits on a curve. He <br />intends to dedicate the remainder of the outlot to the City as pond drainage. <br />Gelbmann asked if there is enough buildable contiguous area without wetland in <br />the middle of the property. <br />Mr. Granger stated that the Rice Creek Watershed District has determined that <br />there is no wetland on the proposed lot. <br />Robinson noted that there is a county ditch along the north lot line that is listed <br />on the county plat. <br />Mr. Granger stated that there is a 10 -foot easement on each side of the north lot <br />line for the ditch. <br />
