• <br />PLANNING & ZONING BOARD <br />May 10, 1995 <br />Mr. Derek expressed concern for the issue regarding the <br />time frame of the covenants, the government mandates 15 <br />years and they would like 30 years. <br />Mr. Johnson inquired if an elderly person over 55 could <br />have a grandchild living with them. Mr. Derek indicated <br />no, that would not be allowed. <br />Mr. Brixius addressed the flexibilities requested; <br />1. Mr. Brixius indicated it is his feelings that <br />the curb requirement should not vary, the Staff <br />reviews a project for the lifetime of the project <br />and the curbing would enhance the looks of the <br />project and be consistent with other developments <br />in the City. <br />2. Mr. Brixius indicated he would not be concerned <br />with rental of garages if the tenant did not own a <br />car, but he was concerned with outside parking. <br />3. With regards to garage fees, Mr. Brixius <br />indicated parking requirements are met for the <br />units by including the garages, if the garages were <br />added by choice, the requirement would not be met <br />and also the concern for outside parking would <br />arise. <br />Mr. Mesich expressed concern for delivery truck traffic <br />and the ability to turn around. Mr. John Johnson, <br />engineer for the development indicated this could be <br />easily resolved. <br />Chair Schaps inquired if the Fire Marshall had reviewed <br />this project. Ms. Wyland indicated he had, and indicated <br />no concerns. <br />Mr. Bill Johnson inquired if there would be a buffer <br />between the development and I35W. Mr. John Johnson <br />indicated a three to four foot berm would be added for <br />buffering the development. He also noted another buffer <br />between the single family homes and the elderly <br />development. <br />Mr. Mesich inquired if part of the 30 year covenant <br />indicates that there will be single ownership of the <br />development. His concern was that units would be sold to <br />individuals, such as townhomes and the development would <br />become inconsistent with varying owners. Mr. Derek <br />indicated through the covenant there would be single <br />ownership. <br />Mr. Brixius indicated in the PDO it could indicate that <br />this is for single ownership and any changes to the <br />subdivision would have to be reviewed by the City. <br />
