• <br />PLANNING & ZONING BOARD <br />May 10, 1995 <br />Mr. Schones inquired about buffering for the single <br />family homes to the Freeway. Mr. Derek indicated they <br />would not be developing the single family homes, but just <br />grading the site and selling the lots. <br />Mr. Herr inquired if there is a mechanism to make sure <br />future owners are aware of the view of Highway 35. <br />Mr. Schones expressed concern that if the developer did <br />not received the waiver on the curbing would the rents be <br />raised. Mr. Derek indicated no the rents would not be <br />raised, there is enough room in the project for <br />adjustments. <br />Mr. Powell indicated the City has worked with the <br />developer in other areas, but does not wish to vary in <br />regards to the curbing. The curbing better defines the <br />roadway and is more attractive. <br />Mr. Brixius indicated the curbing would be around the <br />perimeter, and parking bays, but not on the individual <br />driveways. <br />Mr. Mesich inquired if pets would be allowed. Mr. Derek <br />indicated no pets would not be allowed. <br />Mr. Mesich inquired if rent was based on income. Mr. <br />Derek indicated that HUD sets the guidelines and it would <br />be based on income. <br />Mr. Mesich inquired as to the reason for the substandard <br />street. Mr. Brixius indicated due to configuration of <br />site, the elderly occupancy and the private street, Staff <br />felt it was acceptable. Mr. Powell indicated the street <br />would be 28 feet and the requirement is 32 feet. <br />Mr. Mesich expressed concerns regarding the narrower <br />street, the fire truck ability to turn around and no <br />circulation trail for the elder to walk within the <br />development. <br />Mr. Powell indicated there is a trail to the north side <br />of Elm Street and around the perimeter of the <br />development. <br />Mr. Mesich reiterated his concern for a narrow street and <br />the elderly walking on that street. <br />Ed Schones made a MOTION to approve application 95 -14 -S, <br />Willow Ponds Senior Cottages, Elm Street, Site Plan <br />Review subject to conditions outlined by Staff, and was <br />supported by Bill Johnson. Vote: 6 aye, 1 nay (Mr. <br />Mesich). Motion carried. <br />
