• PLANNING & ZONING BOARD August 9, 1995 Mr.Brixius indicated when the plan comes into effect the land would need to be zoned Public /Semi Public. Currently the City is only looking for legal description of the land, if buildings are proposed, then the rezoning would need to be done. Rick Gelbmann made a MOTION to approve application 95-23 - S, Centennial School District, Minor Subdivision, Elm Street with the four stated conditions and was supported by Tom Mesich. All voted aye. Motion carried. B. 95 -24 -C, R. Carlson, Conditional Use Permit for stockpile of dirt south of Pineridqe II and III. Planning Consultant Brixius briefly reviewed the staff report outlining the request for a Conditional Use Permit under Section 4, Subdivision 33 of the Zoning Ordinance. Mr. Brixius reported the request is to excavate (deepen), the rear yard swale in Pineridge II and III to allow lookout style homes rather than the original full basement ramblers and stockpile the excavated material to the south for future use. The amount of material to be regraded and stockpiled is approximately 7,000 cubic yards. • Mr. Brixius indicated staff recommends approval with the • following conditions: 1. Side slopes shall not be steeper than a 3:1 slope. 2. Height of the stockpile shall not exceed 6 feet. 3. Side slopes shall be seeded and mulched to prevent erosion. 4. Stockpile shall be monitored by owner and kept free of weeds. Chair Pro -tem Robinson inquired as to how far it would be from the rear lots to the stockpile. Mr. Brixius indicated it would be slightly over 100 feet. Chair Pro -tem Robinson inquired as to how long the stockpile would be there. Mr. Ted Matke, the applicant, indicated it would be there for approximately two years, or until the MUSA line changes. Chair Pro -tem Robinson inquired what the stockpile would be used for. Mr. Makte indicated it would be used for top soil.
