This plan shall also show <br />plantings with rye grass or similar material to protect <br />the surface. A final planting plan shall be included <br />that shows how the site will be restored when stock piles <br />are depleted. <br />2. The fill shall be allowed to remain on site until <br />January of 1997 at which time the permit shall become <br />null and void unless an extension of time has be <br />requested by the applicant. <br />3. Other erosion controls may be imposed if upon spring <br />inspection of the site a determination is made that they <br />are necessary. <br />4. Proper permits must be obtained from the MnDOT. <br />5. No additional fill will be allowed on the site. <br />Mr. Landers seconded the motion. All voted aye. Motion <br />carried. <br />92- 53 -ACUP, NSP, Old Birch Street by Radio Tower(s) <br />Mary Kay Wyland reviewed this request which is to construct a <br />16 x 16 communication building, LP tank, and generator on the <br />property currently containing the 500' radio tower. An <br />amended conditional use permit is required as there is an <br />existing permit on the site. Staff would recommend approval <br />with the conditions outlined in the staff report. <br />Three representatives were present from NSP including Ron <br />Obermueller, Dave Schwartz, and Mike Marzatell. They <br />explained that the proposed building is approximately 300' <br />from Birch Street and is one of eight sites being used for 2- <br />way radio communication. The 6' fence surrounding the site is <br />planned to be topped with three strands of barbed wire. Mr. <br />Brixius explained that barbed wire is not a permitted use in <br />a residential district. In regard to the exterior of the <br />building - Mr. Obermueller stated that they could use a brick <br />fascia for aesthetics if necessary. <br />Mr. Gelbmann made a MOTION recommending approval of the <br />request with the following conditions: <br />1. Proper building permits be obtained prior to <br />construction. <br />2. Exterior be brick. <br />
