Motion <br />carried. <br />92 -54 -P, Glen Rehbein, 7317 & 7319 Lake Drive, Subdivision <br />Mary Kay Wyland reviewed this request which is to split a one <br />acre parcel from the remaining 4.81 acre parcel. The property <br />is zoned Light Industrial and the smaller parcel is intended <br />to be sold to D and E Sales, the current occupant. Staff <br />would recommend approval of the request with the conditions <br />outlined in the staff report. <br />There was some discussion by the Planning & Zoning Board <br />concerning condition No. 3 stating that the property owner <br />would waive any rights to petition against the extension of <br />utilities. Mr. Schneider explained that this was standard <br />procedure when unserved property is subdivided and necessary <br />due to the limitations of the City Charter. The P and Z <br />wanted to know if the future property owner agreed with this <br />condition. After some discussion Mary Kay was asked to <br />contact B and E Sales, explain the condition, and obtain their <br />response. <br />Mr. Landers made a MOTION recommending approval of the <br />subdivision with the following conditions: <br />1. Parcel A contain a minimum of 1 acre in size and 150' <br />of lot frontage on Lake Drive. <br />2. Additional right of way as required by MNDOT be <br />dedicated. <br />3. Property owner(s) and subsequent property owners sign <br />a petition waiving their right to petition against the <br />extension of utilities to serve these properties. (if <br />the property owner objects to this requirement the P & Z <br />would table the request until their February 10th meeting <br />- if the property owners have no objections to this <br />requirement then it will be forwarded to the City <br />Council) <br />Mr. Mesich seconded the motion.
