• <br />• <br />• <br />PLANNING & ZONING BOARD <br />2 March 10, 1993 <br />Mr. Jeffrey Shopek of Loucks & Assoicates was present <br />representing Mr. Vaughan, who was also in attendance. He <br />indicated that the School District had approved the request <br />but indicated that they would favor an even land trade - 11 <br />acres for 11 acres. In regard to future plans for the school <br />district property, Mr. Shopek stated that he would be <br />addressing that item at time of preliminary plat review. The <br />minor subdivision is needed at this time for financing <br />purposes - the bank was not interested in having a third party <br />(the school district) involved in the preliminary platting <br />process. <br />After some discussion Mr. Schones made a MOTION and was <br />supported by Mr. Robinson to approve the minor subdivision as <br />recommended by the Planning Consultant with no insinuation <br />that this is an endorsement of the revised concept or approval <br />of a preliminary plat. All Voted aye. Motion carried. <br />B. PUBLIC HEARING: ORDINANCE AMENDMENT REPEALING PUBLIC AND <br />SEMI - PUBLIC USES FROM VARIOUS ZONING DISTRICTS WITHIN THE <br />CITY. <br />Mr. Brixius explained that this proposed amendment was <br />prompted by a desire to introduce additional clarity <br />pertaining to the regulations governing public and proviate <br />parks. This proposed ordinance defines both public and <br />private parks in Section 1. Section 2 -12 repeals various <br />public and semi - public ( schools, parks, etc.) uses from the <br />various zoning districts and provides for them in the PSP <br />Zoning District. Section 13 outlines permitted uses in the PSP <br />District and provides nursery schools and elementary schools <br />as conditional uses. <br />Chairman Schaps opened the Public Hearing for this item 6:55 <br />P.M. <br />Mr. Ken Tice of Black Duck Drive asked if the new definition <br />related to future parks and past parks. Mr. Brixius explained <br />that existing and future parks would have to be zoned or <br />rezoned PSP to conform to the requirements of the new <br />ordinance. <br />Mr. Schones asked what was the definition of Semi - Public. Mr. <br />Brixius explained that Semi- public references areas such as <br />utilities and that the only difference between public and <br />private parks was their ownership and /or control. <br />The Public Hearing was closed at 7:00 P.M. <br />Kathy Nordine asked if we did, in fact, have a private park in <br />the City. Mr. Brixius explained that private parks could only <br />be established through the PDO process. <br />
