In response to <br />questions from the Board, Mr. Soderman explained that this proposal <br />will generate no new employees, no additional parking needs, or <br />additional signage. He expressed concern about providing <br />additional parking spaces at this time and assured the Board that <br />if the need arose he would certainly provide more parting and that <br />he did have the space to do so. <br />MOTION: Schaps moved and was supported by Mesich to approve the <br />request as submitted with the conditions outlined in the staff <br />report except for the following modifications: <br />1. Parking space shall be set aside for future use. <br />All voted aye. Motion carried to approve site /building plan. <br />ITEM 6 - P &Z 92 -05 & 06 <br />Conditional Use Permit and Site /Building Plan for FINA Mart <br />Planning Consultant Brixius explained that this is a request to <br />remove the existing FINA Station on Lake Drive and 35W and replace <br />it with the proposed structure. Staff would recommend approval <br />with the conditions outlined in the staff report. <br />A representative from FINA, Dan Dege was present to review the <br />history of the proposal. He indicated that they had originally <br />wanted to remodel the existing building and the Council said "no" <br />they would rather see a new structure. Therefore, the proposed <br />request. A concern was expressed by the applicant regarding the <br />staff recommendation on signage. They did not feel it was right to <br />consider the whole of the lighted exterior a sign and suggested <br />that only the words FINA be considered sign. They also discussed <br />the fact that there is an existing pylon sign that will be raised <br />to 65', an existing sign on Lake Drive that should be <br />"Grandfathered" approval, and then the lighted wall sign. FINA was <br />advised that the sign on Lake Drive would not be considered <br />"Grandfathered" as this is a new request and all signs can be <br />required to be brought into conformance with the Code. <br />In regard to landscaping, FINA offered to provide a double row of <br />evergreens, 10' apart, balled and burlapped. The car wash is on <br />the plan for concept approval only and will not be constructed <br />until such time as sewer and water is available or the car wash <br />water can be 100% recycled. The City Engineer agreed with and <br />recommended this action in regard to the car wash. The old <br />underground tanks will be removed and new ones installed. Approval <br />for the ponding area is pending from the RCWSD. Curb cuts are <br />greater than required by MnDOT, however, due to proposed use by <br />3 <br />
