Mr. Mesich also asked <br />if the larger dogs were aggressive and if she had <br />considered constructing a larger kennel with runs for the <br />dogs so they would not have to be chained in the yard. <br />Ms. Grandel explained that the dogs afford some <br />protection for the property but are not "attack" dogs. <br />In response to a kennel with runs she indicated that was <br />a possibility but she had not planned on it. <br />Kathleen Nordine asked how many years she has had that <br />number of dogs and Ms. Grandel replied - 15. Kathleen <br />asked why the use was not Grandfathered in? <br />Mary Kay explained that three adjoining property owners <br />had called, not to complain, but to express concern if <br />additional dogs would be allowed. They were advised that <br />the request, if approved, would most likely either <br />decrease the number of dogs or allow the existing number <br />to remain. <br />After some discussion Al Robinson made a motion <br />recommending approval with the conditions listed below, <br />and the addition of Condition I, and J. as suggested by <br />Mr. Mesich. Mr. Gelbmann seconded the motion. All voted <br />aye. Motion carried. <br />CONDITIONS: <br />a. The kennel shall be maintained in a manner so as not <br />to be injurious to the public health, safety or welfare. <br />b. The property shall be kept in a sanitary and healthful <br />condition at all times. <br />c. The property shall be open to complete inspection by <br />any properly designated officer or employee of the city, <br />at any reasonable time. <br />d. No dog shall be allowed to run at large at any time. <br />e. The dogs shall not be permitted to make noise from any <br />cause whatsoever, sufficient to constitute a public <br />nuisance. <br />f. Any kennel kept in violation of any provision of the <br />City Code Section 607 shall be deemed a public nuisance <br />and may be abated as such. <br />g. The kennel shall be restricted to 9 adult dogs, <br />however, as the dogs grow old and expire, they shall not <br />be replaced until such time as the four (4) dog limit, as <br />stated in the code, is reached. <br />h. A variance for lot area shall be made a part of this <br />permit. <br />i. Upon submittal of the formal kennel license <br />application, Ms. Grandel shall supply copies of the AKC <br />Registration for the poodles and include the names and <br />ages of all dogs on the property. <br />j. The dogs situated in the yard area shall be located so <br />
