• PLANNING & ZONING BOARD 3 <br />NOVEMBER 12, 1992 <br />• <br />• <br />dedicate a trail along Birch Street and work with the <br />staff concerning a trail along the lake shore. <br />One concern expressed by the applicant involved moving <br />the east property line so it is perpendicular with the <br />roadway. If this is done, acerage will be reduced and <br />could cause a problem for the site. The church requested <br />action on the subdivision so that they can purchase the <br />property and then develop the final construction plans <br />for later review. <br />Chairman Schaps asked if permission was needed from the <br />Rice Creek Watershed District and /or the Corp. of <br />Engineers. Mr. Brixius stated that the proposed <br />construction meets the requirements of our Shoreland <br />Management Act and would therefore not require review <br />from the Watershed or Corp. However, no drainage plans <br />or grading plans have been reviewed to date and those may <br />need approval from the Watershed or Corp. <br />Mr. Schneider, City Engineer, explained that this <br />property is on the route of a trunk sewer line to the <br />Black Duck pumping station. There also has been interest <br />in development of the property to the west of the <br />proposed church site which would provide for better <br />extension of the overall sewer system in the area. <br />Timing is the key here, the extension of utilities to <br />serve the church would be best accommodated along with <br />development to the west - however, we do not know for <br />certain when this will take place. It is possible the <br />sewer to the east could be used on a temporary basis - <br />either way - utilities are available but the best way to <br />extend them has yet to be determined. <br />Mr. Brixius explained that the P & Z could table the <br />request, or to accommodate the applicant, could approve <br />the subdivision with the condition that final plans be <br />submitted for the conditional use permit. Mr. Schneider <br />stated that since this is a church, and not a developer, <br />the Council may agree with this arrangement. Mr. <br />Robinson stated that if all conditions listed in the <br />staff report are met - he has no problems with the <br />request. Mr. Brixius added that the staff's idea of <br />compliance may differ from the applicant's, however, the <br />use is appropriate for the site. <br />After some discussion Tom Mesich made a motion <br />recommending approval of the subdivision with the <br />following conditions: <br />1. Submitted lot lines are acceptable <br />
