• <br />• <br />• <br />PLANNING & ZONING MEETING <br />August 9, 1989 <br />R -1 to a PUD there has to be a 4/5 vote, and they were unable <br />to get that from council. <br />Since then Mr. Miller has visited with neighbors, and spoke <br />with residents that were against this project, along with the <br />park board chairman. They reached a compromise. <br />Mr. Held presented the board with a revised site plan. This <br />plan has changed in the following ways: <br />1. The dwellings have been reduced from 70 units down <br />to 54 units. <br />2. There is larger green areas on the west side of the <br />project. <br />3. Creation of a trail system that would start at <br />Willow Ponds, cross Sunnygate on the north leading <br />to Second Avenue. From there the trail would be <br />extended west to Sunrise Park through Parkview <br />Estates, and then travel to the north from Sunrise <br />would be facilitated by placing a cul -de -sac at the <br />south end of Sunrise Drive. <br />4. Setbacks have been increased on Elm Street. <br />Residents living to the south of the project will just see <br />green area, people from the Lakeview side will see the <br />project from more of a distance with the 100 foot setback. <br />While John Miller was in negotiations with the developer <br />provisions were made for a sound Homeowner's Association with <br />provision for dues payment in the event of mortgage default, <br />and also a "no- rentals" agreement. <br />Sally Kuether thinks the ponding area is a good thing, and <br />feels this is a good use of the land. She doesn't think <br />however, that it is possible to enforce a "no- rentals" clause <br />in the Homeowner's Association. <br />Alan Irwin asked about landscaping. He stated that he likes <br />the concept, is a good use of the land, and added that he <br />feels it could accommodate even more units. <br />Robert King likes it even better now with less units. <br />Alan Irwin stated that If the setbacks are met on Elm Street, <br />then he is in favor of the project. <br />All members were in favor of the townhome project, the next <br />step is for the plan to be reviewed by council. <br />
