Mr. <br />King seconded the motion and the motion was approved. <br />MINOR SUBDIVISION FOR METROPOLITAN WASTE CONTROL COMMISSION, <br />APPLICATION #89 -40, AND VARIANCE, APPLICATION #89 -44. <br />The Metropolitan Waste Control Commission wishes <br />to purchase a parcel of land measuring 12 x 30 feet located <br />on North Road. The owners of the property are Darwin E. <br />Fletcher and Janet G. Clingingsmith. <br />An existing sewer meter station was originally located on <br />MNDOT right -of -way. At the request of the property owners <br />(Fletcher and Clingingsmith), the land was deeded to them. <br />This shouldn't have occurred - it was an error by the MNDOT <br />people. <br />When sewer construction was started in the area this summer <br />the MWCC became aware that it had neither title nor easement <br />to the land where the meter station was located. Fletcher <br />and Clingingsmith are willing however to sell the MWCC this <br />360 square foot area. <br />MOTION: Fred Chase moved to recommend to City Council <br />approval of a Minor Subdivision for Metropolitan Waste <br />Control Commission, Application #89 -40 for property located <br />in Lot 10, Block 8 of Lexington Park Lake View Addition. for <br />reasons stated in memorandum dated 9/5/89 by Mr. Miller. <br />Sally Kuether seconded the motion, and the motion was <br />approved unanimously. <br />Variance <br />MOTION: Fred Chase moved to recommend to the city council <br />granting a variance to the Metropolitan Waste Control <br />Commission for an undersized lot for property located in Lot <br />10, Block 8 of Lexington Park Lake View Addition, Application <br />#89 -44, based on an improper sale of property by the <br />Minnesota Department of Transportation, and the fact that it <br />is an undersized lot. Al Robinson seconded the motion and <br />the motion was approved unanimously. <br />at 7:17 p.m. a 5 minute recess was called so that the <br />boardmembers could review the minutes of the Special Planning <br />and Zoning Meeting of August 23, 1989. Corrections of the <br />minutes are found on page 1. 7:24 p.m. the meeting was <br />called back to order. <br />
