The board informed him <br />that park dedication would be due prior to final plat <br />approval. <br />MOTION: Mr. King recommended to City Council approval of a <br />Minor Subdivision for Tom Vail, Application #89 -47 as <br />presented. Sally Kuether seconded the motion and the motion <br />was approved unanimously. <br />7:45 p.m. <br />MINOR SUBDIVISION FOR BRAD AND HELEN ELLEDGE FOR PROPERTY <br />LOCATED AT LAKE DRIVE AND 77TH STREET. APPLICATION #89 -48. <br />Helen Elledge complimented Mr. Miller on his memorandum. She <br />stated that their concerns and wishes were all dealt with in <br />his memo. <br />The applicants own a trapezoidal parcel of land located in <br />the southeast quadrant of the intersection of Lake Drive and <br />Oak Lane. There are two legal descriptions for the parcel. <br />The board was presented with a certificate of survey showing <br />a dwelling, garage, kennel and other accessory building <br />located on the west side of the parcel. The entire parcel <br />covers an area of approximately two acres. The applicant <br />wishes to sell the property and a buyer is interested in the <br />western part of the property. Mr. & Mrs. Elledge wish to <br />transfer a 25 foot wide strip of land from the eastern <br />legally described parcel to the western parcel. This would <br />move the kennel and one accessory building onto the western <br />parcel. <br />A variance is also required. John Miller stated that the <br />kennel and accessory building are on the property line and <br />that it is a hardship in the fact that this is a preexisting <br />condition. The applicant assured the board that the kennel <br />will be removed once the purchase agreement has been signed. <br />The board felt the six findings of fact have been met. <br />MOTION: Mr. Irwin moved to recommend to City Council <br />approval of a Minor Subdivision, Application #89 -48, and a <br />• Variance, Application *89-49 with the finding of fact that we <br />can meet the six findings of fact, and conditioned on: <br />1.
