Also, the plat would require six variances. Prokop <br />suggests to recommend that if Menkfeld replats to meet the <br />minimums, and if it means an open space area or curved roads <br />be included this is something the petitioner would have to <br />deal with - some of the economic considerations as they <br />present themselves to him. Also, three lots should be <br />reconfigured into two lots in Block 2, in a manner simular <br />to what is done in block 5. The plan of long rectangular <br />blocks and identical type lots does not promote the goals of <br />the comprehensive plan, that being of encouraging variety <br />and more desireable type homes. Irwin seconded the motion <br />and this motion was carried with Cheryl Nelson abstaining. <br />REQUEST FROM PAUL K. MILLER FOR A MINOR SUBDIVISION FOR LAND <br />LOCATED NEAR 2209 PHELPS ROAD. REQUEST FROM PAUL K. MILLER <br />FOR A VARIANCE FROM THE PUBLIC ROAD FRONTAGE REQUIREMENT. <br />Paul Miller at Acton Construction wishes to sell <br />approximately 5.85 acres to Gene Orfei and Orfei Contracting <br />Incorporated. The land is partially located within Acton's <br />present storage yard and partially across the creek that <br />traverses this property. <br />Phelps Road extends east from County Road 84, 848 feet and <br />dead -ends at the Acton property. If the lot split were <br />approved as originally requested there would be - 1.) No <br />access to the Orfei property on a public street and 2) there <br />would be a cul -de -sac longer than the 500 feet. Both <br />conditions are not permitted by the Lino Lakes Code. <br />From the time of Miller's original request (remember <br />attorney Alan Tschida and Gene Orfei appeared at the <br />Planning and Zoning Boards open mike in March), there has <br />been a considerable amount of discussion regarding these <br />problems. Originally, John Miller asked for a street <br />extension to the Orfei property and an easement through the <br />remainder of the Acton property to the property line on the <br />east. This would eventually assure access from County Road <br />84 to Elmcrest on the City's east boundary. <br />Miller (Acton) had problems with this. Presently fuel tanks <br />are located underground where the extension of Phelps Road <br />would normally be required. Miller states the cost of <br />removing them would be cost prohibitive. In addition Miller <br />states there is a need to control access to the storage <br />yard. If there were an extension of the road, he argues, <br />PAGE 3 <br />
