Planning and Zoning Board April 10, 1985 Page Three PAUL TUBBS - METES AND BOUNDS SUBDIVISION AND VARIANCE TO LOT SIZE IN RURAL DISTRICT Note: Paragraph 1, 3, 4, and 8 under the "Audrey Burque - Metes and Bounds Subdivision" above relate also to this item. Mr. McLean moved that the P & Z recommend to Council approval of the application of Paul Tubbs, representing Al Augustine, Scandia, MN, for property described as Parcels A, B, C and D. The motion will address the subdivision by metes and bounds conveyance. P & Z recommends that Parcels A and B be accepted as drawn on the map except that the road easement be altered to 40' width on the south edge of Parcel B and a 40' width on the north edge of Parcel A; that the 7.8 acres that is in Parcel D be included with the parcel to the east that is owned by Steven Nice to which it adjoins before it is acceptable; that Parcel C (5.1 acres) be accepted and must be included by Robert Sorg in the 2.6 acre tract that fronts on 24th. That in all, the whole subdivision relationship to park dedication (since the Park Board did not see fit to recommend any specific park requirements in this area) that cash be accepted in lieu of land for parcels A, B, C and D. There must be compliance with all sections of Subdivision 35. This motion recognizes that it is granting a variance from the 10 -acre subdivision ordinance, in the cases of Parcels C and D, which are 5.1 and 7.8 acres respectively. By way of explanation for the variance in this case, we are improving on the situation of Robert Sorg which has only 200 feet frontage on 24th Ave. and it increases the frontage by 58' and brings it closer to com- pliance with frontage ordinance and brings the Steven Nice parcel into over 10 acres total. Therefore, our rationale is that we are improving the situations. An 80' roadway easement is included in this plat to serve as a future collector street from east to west from 24th Ave. to County 84. Motion was seconded by Mr. Prokop. Mr. Doocy wanted the fact that Parcels A and B are undersized because of the 40' road right -of -ways to be part of record. Motion carried unanimously. SIGN ORDINANCE It was stated to the audience that the City Council has asked the Planning and Zoning Board to address the sign ordinance, particularly the portion relating to portable signs. Eight to ten people in the audience were attending with interest in this issue. Mr. McLean asked that those wishing to be heard step forward at this time. Mr. Ernie Zelinka appeared voicing a concern of his own on behalf of Forjays and also on behalf of the Chamber of Commerce. The restrictions on portable signs by the City of Lino Lakes has been topic of discussion at recent Chamber of Commerce meetings, wherein several businesspersons from the community have asked that their input be considered in this issue.
