Planning and Zoning Board <br />April 10, 1985 <br />Page Three <br />PAUL TUBBS - METES AND BOUNDS SUBDIVISION AND VARIANCE TO LOT <br />SIZE IN RURAL DISTRICT <br />Note: Paragraph 1, 3, 4, and 8 under the "Audrey Burque - <br />Metes and Bounds Subdivision" above relate also to this item. <br />Mr. McLean moved that the P & Z recommend to Council approval <br />of the application of Paul Tubbs, representing Al Augustine, <br />Scandia, MN, for property described as Parcels A, B, C and D. <br />The motion will address the subdivision by metes and bounds <br />conveyance. P & Z recommends that Parcels A and B be accepted <br />as drawn on the map except that the road easement be altered <br />to 40' width on the south edge of Parcel B and a 40' width <br />on the north edge of Parcel A; that the 7.8 acres that is in <br />Parcel D be included with the parcel to the east that is owned <br />by Steven Nice to which it adjoins before it is acceptable; <br />that Parcel C (5.1 acres) be accepted and must be included by <br />Robert Sorg in the 2.6 acre tract that fronts on 24th. That <br />in all, the whole subdivision relationship to park dedication <br />(since the Park Board did not see fit to recommend any specific <br />park requirements in this area) that cash be accepted in lieu <br />of land for parcels A, B, C and D. There must be compliance <br />with all sections of Subdivision 35. This motion recognizes <br />that it is granting a variance from the 10 -acre subdivision <br />ordinance, in the cases of Parcels C and D, which are 5.1 <br />and 7.8 acres respectively. By way of explanation for the <br />variance in this case, we are improving on the situation of <br />Robert Sorg which has only 200 feet frontage on 24th Ave. and <br />it increases the frontage by 58' and brings it closer to com- <br />pliance with frontage ordinance and brings the Steven Nice <br />parcel into over 10 acres total. Therefore, our rationale is <br />that we are improving the situations. An 80' roadway easement <br />is included in this plat to serve as a future collector street <br />from east to west from 24th Ave. to County 84. <br />Motion was seconded by Mr. Prokop. Mr. Doocy wanted the fact <br />that Parcels A and B are undersized because of the 40' road <br />right -of -ways to be part of record. Motion carried unanimously. <br />SIGN ORDINANCE <br />It was stated to the audience that the City Council has asked <br />the Planning and Zoning Board to address the sign ordinance, <br />particularly the portion relating to portable signs. Eight <br />to ten people in the audience were attending with interest in <br />this issue. Mr. McLean asked that those wishing to be heard <br />step forward at this time. <br />Mr. Ernie Zelinka appeared voicing a concern of his own on behalf <br />of Forjays and also on behalf of the Chamber of Commerce. The <br />restrictions on portable signs by the City of Lino Lakes has <br />been topic of discussion at recent Chamber of Commerce meetings, <br />wherein several businesspersons from the community have asked <br />that their input be considered in this issue. <br />
