152 <br />PLANNING AND ZONING BOARD <br />December 11, 1985 <br />Page Three <br />noticed sometime ago that C & D was operating in Mr. Wolters' <br />building and informed Mr. Wolters that he is required to apply <br />for an amended conditional use permit. <br />Mr. McLean asked if Mr. Wolters is in compliance with the condi- <br />tions of his conditional use permit. Mr. Kluegel said yes, he was. <br />The Board discussed the requirements for screening, paving and outside <br />storage. <br />MOTION: Mr. Cody moved to recommend to Council approval of an <br />amendment to a conditional permit for Mr. Paul Wolters, 7791 Lake <br />Drive, Lino Lakes with the following conditions: 1) wooden fence <br />be extended along south side of the property to the pond in the <br />rear and 40 feet on the west side, 2) all access drives be paved <br />with a minimum of 12 foot wide bituminous or concrete surface, <br />3) the exterior storage area be filled with a minimum of class 5 <br />surface, 4) exterior storage be limited to ten vehicles and no <br />other equipment, parts or product. Approval is recommended because <br />it appears that the applicant has met the requirements of subdivi- <br />sion 5 with respect to conditional use permits. Mr. Goldade <br />seconded the motion. Motion carried unanimously. <br />PAUL TUBBS - METES & BOUNDS SUBDIVISION <br />Mr. Tubbs appeared before the P & Z Board (continuance from last mont <br />with an alternate road plan for a metes and bounds subdivision of lan <br />owned by Mr. Al Augustine in the southeastern portion of the City. <br />At the last meeting of the P & Z, Mr. Tubbs presented a plan which <br />the P & Z Board felt did not incorporate the street /access plan <br />that Mr. Johnson recommended in April, 1985 for that portion of <br />the City. <br />Mr. Tubb's explained that after submitting his second proposal (which <br />the Board received in this month's packet) he thought of an additional <br />change which would provide 20+ acres in parcel F. The Board felt that <br />this change would be acceptable, but that Mr. Tubbs would need to <br />have his surveyor draw up another revision including this change, <br />submit this revision to Mr. Kluegel, and if Mr. Kluegel finds this <br />revision the same as Mr. Tubbs' explanation this evening, then this <br />item can go directly on to the Council for consideration. <br />MOTION: Mrs. Klaus moved to recommend to Council approval of a <br />metes and bounds subdivision as requested by Paul Tubbs for Al <br />Augustine, for a piece of land referred to as Parcels E and F on <br />submitted survey. Mr. Tubbs will submit to Council (after Mr. <br />Kluegel's review for compliance with this evening's discussion) <br />a revision of the survey and road pattern for this subdivision <br />request. The P & Z Board requests that the City Attorney consider <br />a proviso making the area west of the road not a remainder interest <br />The P & Z recommends approval after the revised survey and after <br />City Attorney's review. Mr. Goldade seconded the motion, which <br />carried unanimously. <br />MOTION: Mr. Doocy moved to refer the Paul Tubbs Metes & Bounds <br />Subdivision to the Park Board for their recommendations before <br />Council approval. Mrs. Klaus seconded. Motion carried. <br />
