1 <br />1 <br />1 <br />PLANNING AND ZONING BOARD <br />December 11, 1985 <br />Page Four <br />AMENDMENTS TO CITY CODE <br />Park Dedication - Ordinance #14 -85 <br />The Board discussed the proposed amendment to the City Code with <br />respect to park dedication. They were concerned that the new <br />park dedication amendment calling for $160 per unit or ten per- <br />cent of the fair market land value would generally mean that the <br />City would collect money rather than land for park dedication. <br />The consensus of the Board was that this would not be conducive to <br />procuring land which is so badly needed, particularly in the <br />southeastern portion of the City. <br />MOTION: Mr. Prokop moved to not recommend approval of this ordin- <br />ance ( #14 -85), but rather have it sent back to the originating <br />organization strongly suggesting that the language be changed <br />so that the City has the opportunity to take land at their dis- <br />cretion in plats and metes and bounds subdivisions for park dedi- <br />cation. Motion seconded by Mr. Doocy, and carried unanimously. <br />Day Care Nurseries - Ordinance #13-85 <br />Per P & Z's request at their 11/85 meeting, Ordinance #13 -85 pro- <br />posing an amendment to the code regarding day care nurseries was <br />considered by the P & Z Board. City Attorney, Mr. Hawkins sub- <br />mitted a letter dated 12/10/85 explaining his findings in review <br />of this issue. Mr. Hawkins noted that the amendment which the <br />P & Z was considering this evening does not address day care <br />nurseries of over twelve persons. <br />The Board requested that this Ordinance #13 -85 be returned to <br />the City Attorney and revised to address over twelve persons per <br />his 12/10/85 letter, before forwarding to the Council. <br />Surface Drainage - Ordinance #15 -85 <br />Ordinance #15 -85 was reviewed by the P & Z Board. This ordinance <br />deals with design requirements for off - street parking. <br />The Board realized in discussion that some members interpreted <br />"off- street" parking as driveways and customer parking lots, <br />while other members' interpretation was that "off- street" parking <br />included areas where any motorized vehicle would be stored (such <br />as in exterior storage areas for a business). <br />MOTION: Mr. Cody moved that the words "and storage areas" be <br />added to the proposed amendment, which would clarify and require <br />that exterior storage areas where vehicles are parked be paved <br />with bituminous or concrete surface. Mr. Cody later withdrew this <br />motion. <br />153 <br />
