• <br />• <br />• <br />PLANNING 6 ZONING BOARD <br />May 13, 1987 <br />Page Four <br />EJM PIPE SERVICES - SITE & BUILDING PLAN <br />Mr. Allen Montgomery and Mr. Kluegel explained that the site and <br />building plan submitted by EJM Pipe Services is to construct an <br />office addition to the front of the existing building along Lake <br />Drive. The Board reviewed the submittal and asked particular <br />questions as to landscaping and screening. <br />Mr. & Mrs. Hayes were in attendance and stated that they are next <br />door to EJM Pipe Services in a single family home and feel that EJM <br />is not adequately screened bordering their property and they <br />have full view of trailers in EJM's rear yard and have also had <br />to remove fallen trees along the boundary which have died over <br />the years. In order to alleviate problems with the neighbors, <br />Mr. Montgomery volunteered to plant trees on the Hayes property <br />in order to screen the trailers since there is not enough room <br />on the EJM property to plant trees as a screen to the rear yard. <br />MOTION: Mrs. Nelson moved to recommend to Council approval of the <br />site and building plan of EJM Pipe Services, application 87 -11 <br />with the following conditions: <br />trees be planted to fill the vacancy left from dead trees <br />along the east half of the north property line, creating <br />a tree line with approximately 15' on center, <br />the applicant comply with the stipulations of the condi- <br />tional use permit granted in late 1986, <br />with consent given this evening by Mr. & Mrs. Hayes, EJM <br />will plant trees on the Hayes' property to provide a <br />screen from EJM's rear yard. <br />Motion seconded by Mr. Joyer and carried unanimously. <br />EL REHBEIN & SON, INC. - REZONE <br />Mr. Cody asked if anyone was in attendance to speak to this issue. <br />Mr. Kluegel stated that he understood that this rezone is strictly <br />an administrative task to correct an oversight when the zoning <br />map was approved in 1983. There was confusion as to why E1 Rehbein <br />is named as the applicant if in fact, this is just housekeeping. <br />Mr. Cody said that he would not hear this issue without an EL <br />Rehbein representative or more information and guidance from <br />City administration. Mr. Joyer asked to step down to represent <br />El Rehbein & Son. Mr. Cody felt this would clearly be a con- <br />flict of interest on Mr. Joyer's part. Mr. Joyer said that he <br />felt he should have that right to step down to represent his <br />employer and abstain from participation on the Board for this <br />issue and said that he wanted the City Attorney's opinion on this <br />conflict of interest matter. <br />MOTION: Mr. Prokop moved to table the El Rehbein rezone, applica- <br />tion 87 -17 until more information and guidance is available. Mrs. <br />Nelson seconded the motion which carried with Mr. Joyer abstaining. <br />
