Anoka County and the City Planner recommended approval. <br />Mr. Rud showed concern that with the granting of this variance, he <br />may run into problems if and when he tries to sell his property; <br />otherwise, he is agreeable to leaving the septic system as is and <br />receiving the variance. Members of the Board agreed that they did <br />not wish to cause selling problems for Mr. Rud. They felt that the <br />variance would probably not cause selling problems; the problem <br />recently experienced with mortgage companies has been in dealing <br />with a non - conforming use rather than a property with a variance. <br />Boardmembers felt that the City Attorney should review the situ- <br />ation before granting the variance for Mr. Rud's protection. <br />MOTION: Mr. McLean moved to recommend to Council approval of a <br />variance for Robert A. Rud, 1182 Main Street, Lino Lakes, applica- <br />tion #87 -19 allowing the septic system on the property described <br />within the application to remain as is at a setback less than the <br />10 feet required by ordinance. This application appears to have <br />met the requirements of Section 5, Subd. 7 (Variances). The P & Z <br />Board further recommends that the City Attorney research this situ- <br />ation to assure that granting this variance will not create any <br />difficulty in selling the property or securing a mortgage. Mr. <br />Prokop seconded the motion which carried unanimously. <br />FRED TUMA - HOUSE MOVE -IN PERMIT <br />Mr. Tuma and Mr. Kluegel explained that this application requests <br />approval to move a house to 423 Sherwood Lane. Mr. Kluegel felt <br />that the condition of the house was good. The professional opinion <br />within the application indicated that due to the water table, a <br />mound system septic be installed. Mr. Tuma stated that the home <br />will either be erected as a slab on grade without basement or the <br />basement will be on grade with fill placed around the basement. <br />Mr. Kluegel agreed with these plans and the mound system septic. <br />MOTION: Mr. McLean moved to recommend to Council approval of a <br />house move -in permit for Fred Tuma, application dated 6/16/87, to <br />move a house to 423 Sherwood Lane with the provision that the <br />septic system be installed as recommended in the application and <br />the house erected with sufficient elevation as described this <br />evening to the Building Official's satisfaction. Mrs. Averbeck <br />seconded the motion which carried unanimously. <br />ORDINANCE AMENDMENTS <br />The Board discussed several ordinance amendments. The action <br />taken on these amendments follows, the actual amendments are <br />attached to these minutes. <br />
