`VARIANCE l McDERMOTT) <br />Planning and Zoning <br />May 12, 1982 <br />Page Four <br />SPECIAL USE PERMIT - NEIMCZYK <br />410 This is for a Beauty Shop - 16x16 - in the basement of an existing residence <br />located at 34 Gladstone - crushed rock driveway. <br />r <br />Mr. McLean questioned the entrance? what is the layout? <br />Mr. Prokop asked if this is ah allowed usage? Mr. McLean pointed out that <br />the property owners within 300' must be notified. He suggested that this <br />notification could be by- passed if the owner obtained written consent <br />of her neighbors. <br />Mr. Prolop was concerned how this request complies with permitted <br />residential uses - does this not constitute spot zoning? <br />Mr. McLean said, Yes, with the exception that a special use permit may <br />revoked. Also, Special Use Permits should be issued to the person rather <br />than the land therefore, it is non - transferrable. <br />Mr. Short point out the changes in the new Zoning Ordinance that applies <br />to this request. <br />Mr. McLean moved to recommend this application be tabled for notification <br />of property ownres within 300' and present evidence of mailing at the <br />next Planning and Zoning Board meeting. Seconded by Mr. Prokop. Motion <br />carried unanimously. <br />Mrs. Klaus noted that this establishment must be inspected and approved <br />by the State. <br />Mrs. Neimczyk said she aware of this and said she must have permission <br />from the City before she goes to the State. <br />This request is for a variance for a lot located on West Shadow Lake Drive. <br />Mr. Kluegel pointed out this is the highest lot in the area. Mr. Johnson <br />review the history of these lots for the benefit of the newer owners on <br />the Board. These are lots that were platted for sewers and do not con- <br />tain the required square footage under existing Ordinances. However, <br />these lots are grandfathered in and are buildable with certain stipulations. <br />Mr. McLean questioned the distance of the well from the Lake and Mr. <br />Kluegel said it would be approximately 90 from the shoreline. <br />Mr. McLean moved to recommend approval of this variance for a lot-on <br />West Shadow Lake Drive. Seconded by Mr. Juleen. Motion carried unanimously. <br />REZONE - NATHE <br />0 Mr. Nathe presented the proposed driveway and parking lot, noting the <br />screening along the driveway. <br />Mr. McLean pointed out this cuts the front footage to the lot He felt <br />that none of the recommendations included using a part of this lot for <br />parking for the 49 Club. <br />
