Motion carried unanimously. <br />MOLIN REZONE - CONDITIONAL USE PERMIT <br />Mr. Kluegel presented this request and the reasons for the request. <br />Mr. Molin is requesting the addittion to the existing building to be <br />used for storage. The land is currently zoned LI. The manufacture of <br />cement products is an allowed usage under GI but not LI. <br />Mr. Schumacher summarized the reasons for this noting that in order to <br />bring this operation into conformance with the new Zoning Ordinance it <br />is necessary to rezone to GI. This area is defined as industrial in <br />the comprehensive land use plan. Mr. Schumacher read Mr. Short's letter <br />on his review of this request. Mr. Short recommended the rezoning of <br />the property from LI to GI. <br />Mr. Schumacher felt this zoning was an oversight at the time of the <br />public hearings. If it had been realized that Molin Concrete was being <br />zoned as a non - conforming use, Mr. Molin would have been notified in <br />order for him to have appeared at those meetings and voice his objections. <br />Mrs. Klaus was concerned that this business is being intensified and it <br />is adjancent to a residential area. <br />It was pointed out that if the zoning remains LI, this plant cannot <br />be expanded. Under GI, expansion may take place with a Conditional Use <br />Permit. <br />Mr. Doocy asked how big is the currently used area - the yarding area? <br />Is this the only area that used in the business? No one knew the answer <br />to the area used and this is the only area used at the present time. <br />Mr. Schumacher pointed out that when this operation was began, the LI <br />zoning was the only classification under Ord. #6 that this could be zoned. <br />Mr. Schumacher pointed out that Mr. Molin has been working all summer <br />on a water plan for the RCWB in order to complete this expansion. <br />Someone asked why Mr. Molin did not show up at the hearings on the zoning <br />map and Mr. Schumacher pointed out that all persons who were non - conforming <br />were notified and this property was overlooked in that it was presumed <br />that it was put into the correct classification. <br />There was a suggestion that only a portion of this property be zoned to <br />GI, the remaining be left as LI. <br />Mrs. Klaus moved to recommend to the Council that the Molin Concret <br />rezone application be revised to includeanlythat part of the property <br />necessary to support the operation as it presently exists. Seconded by <br />Mr. Cody. Motion carried unanimously. <br />On considering the Conditional Use Plan, Mr. Kluegel was asked if the <br />site and building plans have been reviewed in accordance with the Ordinance? <br />This would include Items A thru I in the zoning Ordinance. <br />Mr. Kluegel said he had no problems with this request. The requirements <br />on pages 40 thru 45 are the ones being referred to and Mr. Kluerl said <br />they have been complied with. <br />
